    Exploring Grey Literature on SSRN

    There has been a growing discussion in the academic community surrounding the concept of grey literature, a broad term that encompasses documents, data, research, and materials created outside of the traditional pathways of academic publication, and often for non-academic audiences. This work contributes to the information ecosystem by providing sources of knowledge that are timely and broad, filling in gaps in research and offering original data and insights that extend beyond the typical channels for academic publishing.
    In practice, what does this look like? Grey literature includes various reports, conference proceedings, datasets, legal transcripts, working papers, dissertations, blog posts, policy documents, and a wide range of other work that expands the knowledge base and enriches modern scholarship.
    The Purpose of Grey Literature
    Traditional academic publishing involves peer review, a lengthy publication process, and such documents may not be widely accessible to those without academic library privileges. Grey literature may be released more quickly and is often directly accessible for all, allowing current research within a field to be shared in real-time. This provides the opportunity for dissemination of ongoing research, recent developments in policy and government, and relevant reports that help inform the academic discourse of the present and influence the development of research in the future.
    Grey literature provides other benefits beyond its timeliness. The structure of the work itself provides the opportunity to fill in research and knowledge gaps. This can be through the release of up-to-date data, case studies, and reports that don’t fall within the scope of academic publications, or it can present preliminary findings that serve as complementary to previously published works. Grey literature captures perspectives that have a wider scope and therefore rounds out the scholarly record.
    The accessibility and relevance of grey literature allows the work to have significance outside the world of academia. It helps inform policies, programs, and future academic research. Grey literature takes research and data and translates it into real-world impact.
    Joshua Tucker, professor and researcher at NYU, shared his grey literature on SSRN. He was pleased to see that his report  – which would not be included in traditional academic publications – had a presence on SSRN, generating additional attention and citations it wouldn’t have received otherwise. He shared with SSRN that, “This review of the literature was never intended to be an academic article. It was a report commissioned by the Hewlett Foundation, and the Hewlett Foundation put it on its website. I thought people in the policy community were going to see it on the Hewlett website, but I’d love for people to see it in the academic community. I thought that maybe we’d get a few citations out of it, andto throw it up on SSRN, on a whim. And now it’s been downloaded over 40,000 times and continues to be cited all the time. In that sense,filled this really nice niche: we had something that we didn’t write to be an academic publicationweren’t going to send to journals. It’s a nice home for things that don’t have a natural fit.“

Grey literature may be released more quickly and is often directly accessible for all, allowing current research within a field to be shared in real-time. This provides the opportunity for dissemination of ongoing research, recent developments in policy and government, and relevant reports that help inform the academic discourse of the present and influence the development of research in the future. Grey literature provides other benefits beyond its timeliness. The structure of the work itself provides the opportunity to fill in research and knowledge gaps. This can be through the release of up-to-date data, case studies, and reports that don’t fall within the scope of academic publications, or it can present preliminary findings that serve as complementary to previously published works. Grey literature captures perspectives that have a wider scope and therefore rounds out the scholarly record. The accessibility and relevance of grey literature allows the work to have significance outside the world of academia. It helps inform policies, programs, and future academic research. Grey literature takes research and data and translates it into real-world impact. Joshua Tucker, professor and researcher at NYU, shared his grey literature on SSRN. He was pleased to see that his report  – which would not be included in traditional academic publications – had a presence on SSRN, generating additional attention and citations it wouldn’t have received otherwise. He shared with SSRN that, “This review of the literature was never intended to be an academic article. It was a report commissioned by the Hewlett Foundation, and the Hewlett Foundation put it on its website. I thought people in the policy community were going to see it on the Hewlett website, but I’d love for people to see it in the academic community. I thought that maybe we’d get a few citations out of it, andto throw it up on SSRN, on a whim. And now it’s been downloaded over 40,000 times and continues to be cited all the time. In that sense,filled this really nice niche: we had something that we didn’t write to be an academic publicationweren’t going to send to journals.     A new body of work by Andrew Salgadounfurls from a central premise: we are the books we read. The artist, who works between London and New Brunswick, Canada, is literarily insatiable and considers every unread tome an opportunity of “infinite possibility.”
    At BEERS London, Salgado’s Self-Portrait as a Stack of Books presents a series of paintings that open like chapters and together, build a larger narrative. “My Year Of Rest And Relaxation” directly references Ottessa Moshfegh’s bleary novel of the same name and depicts a young protagonist inert and detached. There’s also “Véra,” which portrays a resolute Véra Nabokov writing what might be one of her since destroyed letters.

    Salgado is continually interested in citation and the ways that memories and experiences layer atop and mold one another. Many of the authors he’s drawn to—Virgina Woolf, Jorge Luis Borges, and Margaret Atwood among them— “are influenced by art. By music and painting. They write about it all the time. The word is ekphrasis,” he adds. “Nabokov lists over 150 paintings in his collected works. So why shouldn’t the inverse also be true?”
    Intuitive marks of oil paint and pastel characterize Salgado’s works and seem to build up over time. Irregular stripes and circles add greater depth and dimension to patches of color delineating a dress or facial feature, leaving each scene with a certain indeterminacy. Allowing for interpretation and an array of personal references is essential to the artist’s thinking: “It’s ready for the taking. And whatever you take from it—from the books, or the paintings, or the ideas within—it’s all right. It’s all correct. There are no wrong answers,” he says.

    The Utah court of appeals has sanctioned a lawyer after he was discovered to have used ChatGPT for a filing he made in which he referenced a nonexistent court case.Earlier this week, the Utah court of appeals made the decision to sanction Richard Bednar over claims that he filed a brief which included false citations.According to court documents reviewed by ABC4, Bednar and Douglas Durbano, another Utah-based lawyer who was serving as the petitioner’s counsel, filed a “timely petition for interlocutory appeal”.Upon reviewing the brief which was written by a law clerk, the respondent’s counsel found several false citations of cases.“It appears that at least some portions of the Petition may be AI-generated, including citations and even quotations to at least one case that does not appear to exist in any legal database (and could only be found in ChatGPT and references to cases that are wholly unrelated to the referenced subject matter,” the respondent’s counsel said in documents reviewed by ABC4.The outlet reports that the brief referenced a case titled “Royer v Nelson”, which did not exist in any legal database.Following the discovery of the false citations, Bednar “acknowledged ‘the errors contained in the petition’ and apologized”, according to a document from the Utah court of appeals, ABC4 reports. It went on to add that during a hearing in April, Bednar and his attorney “acknowledged that the petition contained fabricated legal authority, which was obtained from ChatGPT, and they accepted responsibility for the contents of the petition”.According to Bednar and his attorney, an “unlicensed law clerk” wrote up the brief and Bednar did not “independently check the accuracy” before he made the filing. ABC4 further reports that Durbano was not involved in the creation of the petition and the law clerk responsible for the filing was a law school graduate who was terminated from the law firm.The outlet added that Bednar offered to pay any related attorney fees to “make amends”.In a statement reported by ABC4, the Utah court of appeals said: “We agree that the use of AI in the preparation of pleadings is a legal research tool that will continue to evolve with advances in technology. However, we emphasize that every attorney has an ongoing duty to review and ensure the accuracy of their court filings. In the present case, petitioner’s counsel fell short of their gatekeeping responsibilities as members of the Utah State Bar when they submitted a petition that contained fake precedent generated by ChatGPT.”As a result of the false citations, ABC4 reports that Bednar was ordered to pay the respondent’s attorney fees for the petition and hearing, refund fees to their client for the time used to prepare the filing and attend the hearing, as well as donate to the Utah-based legal non-profit And Justice for All.
