• Love Is Blind just got hit with a federal labor complaint. Will it change anything?

    In a first for the reality television industry, the National Labor Relations Board (NLRB) argued on Wednesday that contestants on Netflixs dating show Love Is Blind should be classified as employees a designation that would give them significantly more on-set protections, including the ability to unionize. The filing by the NLRBs regional office in Minneapolis comes after two of the shows former contestants Renee Poche and Nick Thompson levied complaints with the Board, alleging unfair labor practices. Those complaints coincided with lawsuits filed by Poche and another former contestant, Tran Dang, both of whom raised worries about their physical safety on the program.The filing is the start of a long process, and doesnt immediately mean that Love Is Blind contestants have to be classified as employees. Depending on what happens in the new Trump administration, its also likely they may not attain that classification in the near term. Related:Thats because the NLRBs statement is only an initial complaint against the two production companies Kinetic Content and Delirium TV that run the show, and multiple things still have to happen before that statement becomes policy. First, the companies have the option to reach a settlement with the NLRB. If theyre unable to, an administrative court will review the claims of labor violations next spring. Then, any decisions that are made could be subject to a series of appeals. President-elect Donald Trumps ascent to the White House also adds uncertainty. As president, Trump will be able to name his own picks to key NLRB roles, including officials who could push for a favorable settlement for the companies, or drop the case. Kinetic Content (which oversees Delirium TV) and Netflix did not immediately respond to a request for comment. That the NLRB has put forth the complaint is still notable, and spotlights important questions about how reality television contestants are treated, however. Love Is Blind, which has become highly popular on Netflix since it debuted in 2000, is far from the only reality TV show thats seen contestants navigate alleged abusive working conditions and potential threats of violence. If you look at some of their individual contracts, theyre pretty shocking, Day Krolik, an adjunct law professor at New York University and former director of labor relations at NBC, told Vox, of reality show agreements broadly. Some of them say the individual can expect to not have food for a protracted period of time that you may be subject to what many would consider sexual harassment. You know, you agree to all this.This would set an industrywide precedent if it became policyA key aspect of the complaint deals with how the production companies of Love Is Blind classify the contestants on the show. Currently, theyre participants, and not employees, which means productions arent subject to an array of legal requirements around wages, paid leave, or insurance. Notably, the contestants also arent able to unionize and dont have protections under the National Labor Relations Act, which establishes the right to a union. The issue of worker classification has been contested in other industries, too, including at gig economy companies like Uber and Lyft. As independent contractors, for instance, Lyft and Uber drivers are unable to unionize and dont have workplace safety protections, both gaps that have been points of contention. If Love Is Blind contestants were considered employees, theyd be able to unionize and be able to receive crucial labor protections on multiple fronts. If they are considered employees then the employer may have to follow many other laws that cover employees: workers compensation, unemployment insurance, discrimination laws, OSHA, tax laws, says Cathy Creighton, director of Cornell Universitys Industrial and Labor Relations Buffalo Co-Lab.Notably, too, that shift in classification could set a widespread precedent for the entire reality TV industry. The NLRB would evaluate each show on a case-by-case basis, experts tell Vox, but having another show be subject to a filing like this sets a legal standard that could be applied to others as well. I think this would set a precedent that workers in similar situations should be covered employees under the National Labor Relations Act, Laura Padin, director of work structures at the National Employment Law Project, told Vox. Other parts of the NLRB filing take aim at common practices that reality shows are known to use, finding that Love Is Blinds confidentiality agreements, non-compete clauses, and pay-or-stay requirements are also unlawful. Under these agreements, contestants are muzzled about many of their experiences on the show for a certain period of time, and had previously been threatened with a fine of $50,000 if they chose to leave the show early. The filing is unlikely to translate to policy just yetThe NLRBs complaint is the beginning of a lengthy process to change how production companies treat the contestants on Love Is Blind. One of two things will happen next.The filing could be settled by the NLRB and the companies involved: This would involve negotiations between the NLRB and the production companies to try to find terms that both could agree to. If theyre unable to find such an agreement, the complaint will be evaluated by an administrative judge, who will hear arguments from both parties in April. Any decision made by that judge can then be appealed, including to the national board and then federal court. Adding uncertainty into these proceedings is the fact that Trump is widely expected to fire the current NLRB general counsel, who is integral to overseeing these cases. A Trump general counsel could decide that they want to reach a quick settlement with the production companies or even drop the case. Trump is also set to fill the two open seats on the NLRB with Republican members, giving the panel a GOP majority thats set to take a more pro-business direction and rule favorably for companies if they have to consider an appeal. As such, its not likely a reclassification of Love Is Blind contestants, or those of other reality shows, will happen in the near term. Despite this, though, the NLRB announcement brings additional awareness to issues that have plagued the reality TV industry for years and could encourage other complaints, regardless of what happens with the Love Is Blind filing.This could change the reality TV industry forever, Bryan Freedman, Poches attorney, told CNN. (Nintendo)A reader argues that for the Switch 2, Nintendo should make a reverse of the Switch Lite: a non-portable model thats more powerful.Im writing this on Thursday afternoon and I feel confident in saying that the Nintendo Switch 2 (or GTA 6) isnt going to be announced at The Game Awards. I just dont think that Nintendo or Rockstar Games want to do that kind of annoucement at someone elses event, where they dont have complete control over every single factor. Its interesting to me, how the best game makers are all so very different in terms of what they create but surprisingly similar in how they act.In many ways though, Im not that interested in the initial reveal, but more the second one that will inevitably go into more detail about the games. Given how many rumours there have been recently, it would now be a shock if the Switch 2 looked very different from the current Switch, bar this extra pedal on the back and some other minor differences. But thats fine. The physical design of the Switch has been a proven success, and I am happy for it to be iterated on.What I want from the Switch 2 is for it to be more powerful, not just for the sake of it but so that it can run all or most current gen games. I realise thats probably not likely this generation, even if it has been a small leap from last gen, but thats why I would like them to do an equivalent of the Switch Lite, but instead of being portable-only Id like it to be not portable at all and more powerful.This very idea, of there being two models of the Switch 2, was suggested by a rumour a year or so ago but I have never heard it brought up again, which means its either not true, and someone just made it up, or Nintendos lawyers got to them. Sadly, I feel the more likely explanation is the first one.The thing is though, the Switch Lite is a special model that removes the main gimmick of the console (and loses the meaning of its name) in order to offer a cheaper version for a specific use and audience. What I am arguing for is to simply do the opposite: a more expensive version for a different audience.Im not suggesting a 700 PS5 Pro monstrosity, but I dont think that would be necessary. It must be possible to approximate the PlayStation 5s power much more easily now than it was four years ago, especially as the Switch 2 wouldnt need a disc drive, so youre already looking at something more equivalent to the PlayStation 5 Digital Editions price, which is around 350 at the moment.Thats less than 100 more than the Switch OLED, so were not talking about some massive leap in price. Thats why I think my suggestion is reasonable, because a more powerful Switch 2 will immediately allow it access to a much wider range of third party games. Remove the portable features, like the detachable Joy-Cons (which the Switch Lite also doesnt have) and I think youd be able to keep the price quite low.Now, I know what youre thinking: Nintendo would not want certain Switch 2 games to only work on one model but theyve done that multiple times before with their portables, going as far back as the Game Boy Color when it was quite commonplace and as recently as the New Nintendo 3DS, which had over half a dozen games which only worked on it and not standard versions of the console (Xenoblade Chronicles 3D was the most famous).So, all Im asking for is this: a non-portable version of the Switch 2 that is less than 400 and which is powerful enough to run Xbox Series X/S and PlayStation 5 games. (AdHoc Studio)Fans of Telltale Games should keep an eye out for new superhero game Dispatch, which may end up being the best adventure game of 2025.Anyone hoping for an update from Telltale Games on The Wolf Among Us 2 at The Game Awards 2024 will have come away thoroughly disappointed.The sequel was originally meant to be out last year, but Telltale has since said nothing about its progress. The only thing weve heard is that its not been cancelled, despite Telltale suffering a round of layoffs towards the end of 2023.However, something Telltale-esque did debut during The Game Awards last night: a narrative driven superhero game called Dispatch, thats being worked on by a number of ex-Telltale staff.The game centres on Robert Robertson, who was once an Iron Man-like superhero called Mecha Man. That was until his fancy mech suit was destroyed, leaving him incapable of performing superheroics.Instead, he takes up the role of a dispatcher, meaning that instead of fighting bad guys its his job to deploy the right heroes to handle crimes and emergencies. All the while navigating his new working relationships, rehabilitating a team of former supervillains, and rebuilding his suit.Based on the trailer, Dispatch certainly shares all the Telltale hallmarks, with narrative choices dictating how the story progresses. Dispatching heroes though, looks like a fun gameplay mechanic and the games graphics and animation is considerably better than the Telltale norm.Dispatch is in development at AdHoc Studio, which was formed by former Telltale employees in the wake of the developers closure, but before its surprise comeback. In fact, this appears to be the studios first project, although it is apparently assisting Telltale with its development on The Wolf Among Us 2 as well.More TrendingThe games Steam listing, and the trailer, specifically highlights how Dispatch shares the same writers and directors as the first The Wolf Among Us and the original Tales From The Borderlands.It also boasts a star-studded cast, from TV stars like Breaking Bads Aaron Paul and high-profile voice actors like Laura Bailey to big-name YouTubers like Jacksepticeye and MoistCr1TiKaL.When is Dispatch being released?Dispatch is slated for a 2025 release but theres nothing more specific than that at the moment. Assuming nothing goes wrong, it may well come out before The Wolf Among Us 2.Dispatch is scheduled to launch on PC via Steam as well as consoles. AdHoc Studio hasnt specified precisely which consoles, though PlayStation 5 and Xbox Series X/S releases feel like a safe bet at least.   • 1 in 6 Congresswomen Targeted by AI-Generated Sexually Explicit Deepfakes

    More than two dozen members of Congress have been the victims of sexually explicit deepfakes and an overwhelming majority of those impacted are women, according to a new study that spotlights the stark gender disparity in this technology and the evolving risks for womens participation in politics and other forms of civic engagement. The American Sunlight Project (ASP), a think tank that researches disinformation and advocates for policies that promote democracy, released findings on Wednesday that identified more than 35,000 mentions of nonconsensual intimate imagery (NCII) depicting 26 members of Congress 25 women and one man that were found recently on deepfake websites. Most of the imagery was quickly removed as researchers shared their findings with impacted members of Congress.We need to kind of reckon with this new environment and the fact that the internet has opened up so many of these harms that are disproportionately targeting women and marginalized communities, said Nina Jankowicz, an online disinformation and harassment expert who founded The American Sunlight Project and is an author on the study. Nonconsensual intimate imagery, also known colloquially as deepfake porn though advocates prefer the former, can be created through generative AI or by overlaying headshots onto media of adult performers. There is currently limited policy to restrict its creation and spread.ASP shared the first-of-its-kind findings exclusively with The 19th. The group collected data in part by developing a custom search engine to find members of the 118th Congress by first and last name, and abbreviations or nicknames, on 11 well-known deepfake sites. Neither party affiliation nor geographic location had an impact on the likelihood of being targeted for abuse, though younger members were more likely to be victimized. The largest factor was gender, with women members of Congress being 70 times more likely than men to be targeted. ASP did not release the names of the lawmakers who were depicted in the imagery, in order to avoid encouraging searches. They did contact the offices of everyone impacted to alert them and offer resources on online harms and mental health support. Authors of the study note that in the immediate aftermath, imagery targeting most of the members was entirely or almost entirely removed from the sites a fact theyre unable to explain. Researchers have noted that such removals do not prevent material from being shared or uploaded again. In some cases involving lawmakers, search result pages remained indexed on Google despite the content being largely or entirely removed.The removal may be coincidental. Regardless of what exactly led to removal of this content whether cease and desist letters, claims of copyright infringement, or other contact with the sites hosting deepfake abuse it highlights a large disparity of privilege, according to the study. People, particularly women, who lack the resources afforded to Members of Congress, would be highly unlikely to achieve this rapid response from the creators and distributors of AI-generated NCII if they initiated a takedown request themselves. According to the studys initial findings, nearly 16 percent of all the women who currently serve in Congress or about 1 in 6 congresswomen are the victims of AI-generated nonconsensual intimate imagery.Jankowicz has been the target of online harassment and threats for her domestic and international work dismantling disinformation. She has also spoken publicly about being the victim of deepfake abuse a fact she found out through a Google Alert in 2023. You can be made to appear in these compromised, intimate situations without your consent, and those videos, even if you were to say, pursue a copyright claim against the original poster, as in my case they proliferate around the internet without your control and without some sort of consequence for the people who are amplifying or creating deepfake porn, she said. That continues to be a risk for anybody who is in the public eye, who is participating in public discourse, but in particular for women and for women of color.Image-based sexual abuse can have devastating mental health effects on victims, who include everyday people who are not involved in politics including children. In the past year, there have been reports of high school girls being targeted for image-based sexual abuse in states like California, New Jersey and Pennslyvania. School officials have had varying degrees of response, though the FBI has also issued a new warning that sharing such imagery of minors is illegal. The full impact of deepfakes on society is still coming into focus, but research already shows that 41 percent of women between the ages of 18 and 29 self-censor to avoid online harassment.That is a hugely powerful threat to democracy and free speech, if we have almost half of the population silencing themselves because theyre scared of the harassment they could experience, said Sophie Maddocks, research director at the Center for Media at Risk at the University of Pennsylvania. There is no federal law that establishes criminal or civil penalties for someone who generates and distributes AI-generated nonconsensual intimate imagery. About a dozen states have enacted laws in recent years, though most include civil penalties, not criminal ones. AI-generated nonconsensual intimate imagery also opens up threats to national security by creating conditions for blackmail and geopolitical concessions. That could have ripple effects on policymakers irrespective of whether theyre directly the target of the imagery.My hope here is that the members are pushed into action when they recognize not only that its affecting American women, but its affecting them, Jankowicz said. Its affecting their own colleagues. And this is happening simply because they are in the public eye. Image-based sexual abuse is a unique risk for women running for office. Susanna Gibson narrowly lost her competitive legislative race after a Republican operative shared nonconsensual recordings of sexually explicit livestreams featuring the Virginia Democrat and her husband with The Washington Post. In the months after her loss, Gibson told The 19th she heard from young women discouraged from running for office out of fear of intimate images being used to harass them. Gibson has since started a nonprofit dedicated to fighting image-based sexual abuse and an accompanying political action committee to support women candidates against violations of intimate privacy. Maddocks has studied how women who speak out in public are more likely to experience digital sexual violence.We have this much longer, women should be seen and not heard pattern that makes me think about Mary Beards writing and research on this idea that womanhood is antithetical to public speech. So when women speak publicly, its almost like, OK. Time to shame them. Time to strip them. Time to get them back in the house. Time to shame them into silence. And that silencing and that shaming motivation we have to understand that in order to understand how this harm is manifesting as it relates to congresswomen. ASP is encouraging Congress to pass federal legislation. The Disrupt Explicit Forged Images and Non-Consensual Edits Act of 2024, also known as the DEFIANCE Act, would allow people to sue anyone who creates, shares or receives such imagery. The Take It Down Act would include criminal liability for such activity and require tech companies to take down deepfakes. Both bills have passed the Senate with bipartisan support, but have to navigate concerns around free speech and harm definitions, which are typical hurdles to tech policy, in the House. It would be a dereliction of duty for Congress to let this session lapse without passing at least one of these bills, Jankowicz said It is one of the ways that the harm of artificial intelligence is actually being felt by real Americans right now. Its not a future harm. Its not something that we have to imagine. In the absence of congressional action, the White House has collaborated with the private sector to conceive creative solutions to curb image-based sexual abuse. But critics arent optimistic about Big Techs ability to regulate itself, given the history of harm caused by its platforms.It is so easy for perpetrators to create this content, and the signal is not just to the individual woman being targeted, Jankowicz said. Its to women everywhere, saying, If you take this step, if you raise your voice, this is a consequence that you might have to deal with. If you have been a victim of image-based sexual abuse, the Cyber Civil Rights Initiative maintains a list of legal resources.
