Following on from the US Department of Justices (DOJ) antitrust win against Google in August, legal battles facing the tech giant have turned to the UK, with news that the Competition Appeal Tribunal (CAT) has paved the way for a 7bn case against Google to proceed.Google will now have to defend its business practices in a landmark legal action brought by Nikki Stopford, co-founder of Consumer Voice, and legal firm Hausfeld & Co LLP.The complaint against Google has two parts. The first concerns Googles advertising model and sponsored searches, whereby advertisers pay to appear higher in Google Search results. The second relates to Googles commercial agreement with Apple.Regarding its advertising model, a market study by the Competition and Markets Authority (CMA), presented in its Online platforms and digital advertising report, found the return on capital employed by Google parent Alphabet was 39% on average between 2011 and 2021. The CMA analysis concluded that this figure had been well above any reasonable competitive benchmark for many years.Google was charging more for ads somewhere in the region of 30% to 40% more than they would be if they were behaving in a competitive environment, she said. A higher price for ads means more cost, which is then factored into the cost of products and services.Businesses have little choice, according to Stopford, as 90% of web searches use Google Search. Even if a product is purchased on the high street, people tend to search online before visiting a store, she said, and whether it is purchased online or in-store, the cost of online advertising is reflected in the price consumers pay.We think that because the cost of advertising is higher for businesses because most businesses are using Google ads to advertise their products, then the impact of those higher costs is impacting all consumers, whether theyre bought in a store or online, through higher prices, said Stopford, adding that this has meant that, as a whole, people are paying in the region of 7bn more than they should.Regarding the second part of her complaint, Stopford said through its commercial agreement with Apple, Google has paid billions to ensure that Google Search is the default search on iPhones and other Apple devices that use iOS.This is the same argument used by the US DOJ, which recently won a landmark legal victory against Google. The judge, Amit Mehta, ruled that the billions paid to Apple and Samsung to ensure Google Search is the default internet search engine on their devices was anticompetitive (see In the US box).Another potential legal battle facing the tech giant is that the Digital Markets, Competition and Consumers Act could be used by the Competition and Markets Authority to regulate the major digital technology providers.The CMA recently announced it was looking at whether intervention was needed in the mobile browser market. This would impact both Apple and Google parent Alphabet. The CMAs Mobile browser and cloud gaming provisional decision report has identified several features in mobile browsers, browser engines and in-app browsing technology that restrict competition.We have provisionally found that various types of policies implemented by Apple are holding back innovation from other browsers, the report authors wrote.While there is plenty of speculation over what the incoming Trump administration plans to do regarding oversight of the tech sector, the US Department of Justice (DOJ) has been making headlines across the web, with reports that it intends to ask Alphabet to offload the Google Chrome browser.In a blog, Kent Walker, president of global affairs and chief legal officer at Google and Alphabet, warned that the DOJs plans would hurt innovative services, like Firefox, which depend on charging Google for search placement. Walker claimed this would deliberately hobble peoples ability to access Google Search. He also warned that the appointment of a technical committee would have enormous power over web users online experience and result in government micromanagement of Google Search and other technologies.Mozilla, the company behind the Firefox browser, urged the judge to consider further remedies that achieve antitrust aims against Google but do not harm independent browsers and search engines.The US Department of Justices proposed remedies, aimed at improving search engine competition, would unnecessarily impact browser competition. If implemented, the prohibition on search agreements with all browsers regardless of size and business model will negatively impact independent browsers like Firefox and have knock-on effects for an open and accessible internet, said Mozilla.Mozilla warned that the proposed remedies would harm independent browsers without material benefit to search competition.True change requires addressing the barriers to competition and facilitating a marketplace that promotes competition and consumer choice in search, browsers, and beyond, it said. We strongly urge the court to consider remedies that improve search competition without harming independent browsers and browser engines.One of the areas highlighted in the provisional report was that web browsers that run on iOS need to use Apples browser engine, called WebKit, which determines what competing mobile browsers can do on iOS. We have provisionally found that this limits the extent to which competitors can differentiate their browsers and offer enhanced features to iOS users, the authors noted.They also provisionally found that Apple may have withheld access or delayed giving competing mobile browsers using WebKit the same level of access and functionality as its own browser, Safari.Googles product design choices also make it significantly harder for consumers to drive competition by actively choosing which browser they use, the provisional report stated.Under the Digital Markets, Competition and Consumers Act, the CMA can look at whether competition among digital giants such as Apple and Google is working.Margot Daly, chair of the CMAs independent inquiry group, said: Markets work best when rival businesses are able to develop and bring innovative options to consumers. Through our investigation, we have provisionally found that competition between different mobile browsers is not working well and this is holding back innovation in the UK.Apple responded to the findings of the provisional report, saying: Apple believes in thriving and dynamic markets where innovation can flourish. We face competition in every segment and jurisdiction where we operate, and our focus is always the trust of our users. We disagree with the findings in the report regarding Safari, WebKit and in-app browsing on iOS.We are concerned that the interventions discussed in the report for future consideration under the Digital Markets, Competition and Consumers Act would undermine user privacy and security, and hinder our ability to make the kind of technology that sets Apple apart. We will continue to engage constructively with the CMA as their work on this matter progresses.The stage is now set for a confrontation between Big Tech, used by billions of people around the world, and regulators in the US and UK, seeking to put some controls over their power.Earlier this year, the EU Digital Markets Act (DMA), which came into force in March 2024, resulted in Google making changes to Android to give users a choice of default browser, search engine and payment provider. Apple has needed to make equivalent changes on iOS.Meanwhile, in the US, following a ruling in which Alphabet was found to have acted in an anti-competitive manner, the US DOJ is now looking to force the company to offload its Chrome browser.There are similarities between the regulators investigations and Stopfords complaint. Beyond its investigation into Googles business practices relating to the Google search engine, the US DOJ is also investigating whether Google has monopolised the advertising technology (adtech) market.Both Apple and Alphabet are using security as a key reason for keeping the status quo. A team of data scientists at York St John University have unveiled a cutting-edge tool designed to spot and alert people to deepfake images being used to spread misinformation and other cyber nasties.Created with support from colleagues at the University of Essex and developers at Colchester-based Nosh Technologies, the Pixelator v2 tool uses a never-before-tried combination of image veracity techniques to identify subtle differences in imagery with far greater accuracy than before. In testing, it has been shown to detect alternations as small as a single pixel in size.The team behind Pixelator v2 hopes it will prove a valuable resource to those with the greatest need for accuracy, in particular cyber security professionals, analysts and researchers.In an era where images dominate communication, the ability to understand visual authenticity has never been more critical, said lead researcher Somdip Dey, a lecturer in data science at York St John.According to Deys team, standard tools used to tease out fake images often fail to account for subtle, yet critical, changes in images. Pixelator v2 differs from these by integrating two new metrics LAB (CIE-LAB) Colour Space Analysis and Sobel Edge Detection which enable it to offer a more robust and nuanced approach to identifying variations, even very minor ones.LAB Colour Space Analysis is a perceptual colour model to mimic human vision, enabling Pixelator v2 to spot differences that may not be immediate visible to the naked eye. Sobel Edge Detection, meanwhile, is designed to highlight structural variations in images, which could include almost imperceptible changes to edges and boundaries that a human observer would also miss.Combining these two techniques makes the tool ideal for applications in cyber security, where the ability to swiftly and accurately compare images plays a key role in a number of tasks, such as tamper detection, authentication and analysis, said Dey.Having evaluated Pixelator v2 against other popular methods, the team said it has clearly demonstrated its superior performance when it comes to detecting perceptual and structural differences. They believe the tool not only provides more accurate image comparison, but also enhances overall security by making it harder for subtle variations to slip through the net.Given the advent of generative artificial intelligence (GenAI) tools capable of creating extremely realistic images, and their advancing capabilities, Dey said the team was conscious that distinguishing between real and AI-generated content was becoming increasingly challenging.The team said Pixelator v2 may be a significant step towards addressing this issue because by enhancing our knowledge of how images differ perceptually, it lays the groundwork for future projects focused on detecting AI-generated images.This tool is a stepping stone towards a broader mission, developing technology to detect and predict AI-generated fake images. As generative AI becomes more widespread, tools like Pixelator v2 are essential in helping consumers and professionals navigate the fine line between reality and fabrication, said Dey.The York St John research team is already actively working on the next phase of the project to extend Pixelator v2s capabilities towards detecting and predicting GenAI-based images. Hes currently ranked No. 4 in the middleweight division, and No. 2 Israel Adesanya is rumored to be headed for a fight with No. 6 Nassourdine Imavov in February.Depending on the timelines, it makes sense to think that Whittaker could potentially fight the winner of that matchup. If its Adesanya, it would mean a rematch with another former world champion.If its Imavov, Whittaker would face a rare challenge against a highly rated middleweight he hasnt fought before. Thats not the only scenario for Whittaker.No. 6 Caio Borralho is looking for an opponent after unsuccessfully campaigning to fight Adesanya. No. 7 Marvin Vettori could be making his Octagon return sometime in the next three to six months.No. 8 Jared Cannonier is still a tough out, but hes 40 years old. Thats a fight Whittaker would be favored to win too. There are several options for Whittaker once hes ready to return, and it doesnt seem as though the UFC will rush one of their most consistent fighters back into the Octagon before hes ready.

The summit, which ran into overtime on Sunday as tensions mounted, represented an ambitious effort to develop an expansive finance package capable of addressing escalating climate challenges.However, amid the pivotal climate finance discussions, another critical issue also gained traction at the conference: the impacts of climate change on human health.In a year marked by climate change-driven disasters, including hurricanes that ravaged the American Southeast and extreme heat that enveloped the Middle East, the climate crisis has exacted a visible toll on health outcomes. This summer, which saw the hottest day on record in terms of daily global average temperature, raised the risk for heat-related illnesses. Last month in Spain, flash floods led to at least 219 deaths. A new survey study in The Lancet Planetary Health of nearly 16,000 young Americans found that 42.8% reported an impact of climate change on self-reported mental health.Against the backdrop of this troubling reality, COP29 sought to imbue the climate talks with a health perspective. In a statement titled The Health Argument for Climate Action, Dr. Tedros Adhanom Ghebreyesus, director-general of the World Health Organization, reminded delegates of the importance of fighting for climate action to protect health.We care about rising sea levels and temperatures because they take land and homes, they make our planet less habitable, they contribute to cardiovascular disease, and they fuel the spread of communicable diseases to new places, Dr. Ghebreyesus said. We care about extreme weather events because they take lives and livelihoods, and damage infrastructure; And we care about air pollution because it fills our lungs with poison. Thats why we say the climate crisis is a health crisis.COP29 wasnt the first UN Climate Change Conference to explicitly call attention to this matter. At COP28 in Dubai last year, an inaugural Health Day convened high-level health stakeholders from across the world around the intersection of climate change and health. A climate-health ministerial, co-organized by the WHO, the COP28 Presidency and the UAE Ministry of Health and Prevention, culminated in the passage of the COP28 UAE Declaration on Climate and Health, a voluntary call to action that acknowledged the health dimensions of the climate crisis and encouraged the pursuit of requisite measures.MORE FROMFORBES VETTEDCOP29 built on these outcomes with numerous events that put public health on the agenda. At the UN Climate Change Pavilion, the Wellcome Trust hosted the panel The Power of Health in Unlocking Climate Action to a packed audience. At the COP29 Health Pavilion, events spanned diverse climate-health themes, including Gender and Equity in Climate and Health, Advancing Climate Literacy to Shape Sustainable Healthcare and Aligning Food Systems, Nutrition and Climate Action.In addition, the WHO engaged in several public-facing efforts to urge the incorporation of health considerations into broader policy initiatives. The organization unveiled a detailed report, Quality criteria for integrating health into Nationally Determined Contributions, that provided guidance for countries to align their climate action plans, known as NDCs, with health priorities. NDCs must be reassessed every five years, and with the next deadline to do so approaching in 2025, the time is ripe for embedding health-related climate targets.The WHO also updated their virtual course, Climate Change Negotiations and Health, available via the One UN Climate Change Learning Partnership. The educational program provided a primer on the negotiations process at COP29, including the ways that health topics fit into the contours of the summits wider proceedings.As delegations shift their focus to prepare for COP30 in Brazil next year, the foundation laid by COP29 to advance dialogue and solutions around the intersection of climate change and health will be paramount.

By ROD McGUIRK / APNovember 27, 2024 6:59 AM ESTMELBOURNE, Australia Australias House of Representatives on Wednesday passed a bill that would ban children younger than 16 years old from social media, leaving it to the Senate to finalize the world-first law.The major parties backed the bill that would make platforms including TikTok, Facebook, Snapchat, Reddit, X and Instagram liable for fines of up to 50 million Australian dollars ($33 million) for systemic failures to prevent young children from holding accounts.The legislation passed 102 to 13. If the bill becomes law this week, the platforms would have one year to work out how to implement the age restrictions before the penalties are enforced.Opposition lawmaker Dan Tehan told Parliament the government had agreed to accept amendments in the Senate that would bolster privacy protections. Platforms would not be allowed to compel users to provide government-issued identity documents including passports or drivers licenses, nor could they demand digital identification through a government system.Will it be perfect? No. But is any law perfect? No, its not. But if it helps, even if it helps in just the smallest of ways, it will make a huge difference to peoples lives, Tehan told Parliament.The bill was introduced to the Senate late Wednesday but it adjourned for the day hours later without putting it to a vote. The legislation will likely be passed on Thursday, the Parliament's final session for the year and potentially the last before elections, which are due within months.The major parties support all but guarantees the legislation will pass in the Senate, where no party holds a majority of seats.Lawmakers who were not aligned with either the government or the opposition were most critical of the legislation during debate on Tuesday and Wednesday.Criticisms include that the legislation had been rushed through Parliament without adequate scrutiny, would not work, would create privacy risks for users of all ages and would take away parents authority to decide whats best for their children.Critics also argue the ban would isolate children, deprive them of positive aspects of social media, drive children to the dark web, make children too young for social media reluctant to report harms encountered, and take away incentives for platforms to make online spaces safer.Independent lawmaker Zoe Daniel said the legislation would make zero difference to the harms that are inherent to social media.The true object of this legislation is not to make social media safe by design, but to make parents and voters feel like the government is doing something about it, Daniel told Parliament.There is a reason why the government parades this legislation as world-leading, thats because no other country wants to do it, she added.The platforms had asked for the vote to be delayed until at least June next year when a government-commissioned evaluation of age assurance technologies made its report on how the ban could be enforced.Melbourne resident Wayne Holdsworth, whose 17-year-old son Mac took his own life last year after falling victim to an online sextortion scam, described the bill as absolutely essential for the safety of our children.Its not the only thing that we need to do to protect them because education is the key, but to provide some immediate support for our children and parents to be able to manage this, its a great step, the 65-year-old online safety campaigner told The Associated Press on Tuesday.And in my opinion, its the greatest time in our countrys history, he added, referring to the pending legal reform.
