    This is an adapted excerpt from the March 17 episode of "Jos Daz-Balart Reports."Early Monday morning in a post on his social media site, President Donald Trump claimed Joe Bidens pardons for members of the House Jan. 6 committee are invalid due to the former presidents use of an autopen:The Pardons that Sleepy Joe Biden gave to the Unselect Committee of Political Thugs, and many others, are hereby declared VOID, VACANT, AND OF NO FURTHER FORCE OR EFFECT, because of the fact that they were done by Autopen. In other words, Joe Biden did not sign them but, more importantly, he did not know anything about them!Before I was a lawyer, I was a congressional aide, so Ive used an autopen before. Its essentially a machine set up to mimic someones signature exactly. Its often used when an office holder, or someone else, has to sign so many documents that it would be impracticable for them to do so by hand.In 2005, the Office of Legal Counsel at the Justice Department which basically serves as the Mother, may I? division of the agency clarified a presidents use of an autopen, issuing an opinion that it was within the executive's constitutional powers to sign a bill via an autopen, at their own direction.We emphasize that we are not suggesting that the President may delegate the decision to approve and sign a bill, only that, having made this decision, he may direct a subordinate to affix the Presidents signature to the bill, the opinion states.By extension, a president should also be able to direct that a pardon be issued under an autopen. There should be no distinction between a presidents powers to sign and authorize a piece of legislation and their pardon power. I would also argue that a presidents power with respect to pardons is actually greater than their role in signing a piece of legislation. So if its constitutionally valid for a president to sign a piece of legislation by autopen, there should be no impediment to them doing so with a pardon.If its constitutionally valid for a president to sign a piece of legislation by autopen, there should be no impediment to them doing so with a pardon.In that same post, Trump also claimed, without evidence, that Biden did not know anything about these pardons. While the Constitution does not allow a president to revoke a pardon, it appears Trump may direct his Justice Department to carry out an investigation into this matter. That means if you're one of these pardon recipients, the question now becomes: How do you prove that the then-president directed the use of an autopen to sign your pardon? The onus will fall on those who have received pardons to prove that their pardon is legitimate. Thats where this is likely headed next.

    Googles parent company Alphabet is again in advanced talks to acquire cloud cybersecurity startup Wiz, a person familiar with the deal told TechCrunch. The two companies were close to securing a deal at a $23 billion valuation last summer, but the transaction failed to materialize.This time, the price being discussed is higher, the person said. Sometimes hiring a CFO is a sign of getting books ready for a public offering.One of the reasons the talks failed previously was the inability of the two companies to agree on whether Wiz would remain as a separate division or be integrated into Google Cloud, according to the Wall Street Journal.High regulatory scrutiny for large transactions during the Biden administration also contributed to the deals breakdown last summer, the person familiar said.Other investors have told TechCrunch that they are seeing an increase in M&A activity.     Its gloves off in one of the more tense rivalries in the world of startups. HR company Rippling Monday morning announced a lawsuit against Deel, another big player in the same space. The dramatic 50-page complaint alleges racketeering, misappropriation of trade secrets, tortious interference, unfair competition, and aiding and abetting a breach of fiduciary duty. The lawsuit is largely centered on an employee whom Rippling claims was working as a spy for Deel.Deel has denied the allegations in a statement to TechCrunch in an equally florid way, setting the stage for the airing of yet more dirty laundry:Weeks after Rippling is accused of violating sanctions law in Russia and seeding falsehoods about Deel, Rippling is trying to shift the narrative with these sensationalized claims, a spokesperson said in a statement provided to TechCrunch. We deny all legal wrongdoing and look forward to asserting our counterclaims.Is this town big enough for the both of us?The HR technology space is highly competitive, featuring not only major incumbents SAP, ADP, Workday among them but also numerous startups targeting the many different aspects of HR, such as payroll, recruitment, training, compensation and benefits management, and onboarding. Companies like Deel and Rippling aim to provide an all-in-one platform for these services.When the going is good and the economy is on an upswing such as during the pandemic, when organizations scrambled for better tools to hire, fire, and manage people across disparate locations the crowded market is less of an issue. But the love-in ends when times get tougher, especially when two companies are as close in size as Rippling and Deel and target the same customers. (One indicator of how directly these two are competing: Ripplings valuation is just over $13 billion; Deel was last valued at more than $12 billion.)Tensions between Deel and Rippling began playing out publicly well before this lawsuit. Last year, Rippling launched a market campaign that took direct aim at Deel, featuring a Snake Game. The game, still accessible, portrays Deel as a snake and accuses the company of charging higher fees than Rippling.The rivalry took another turn when a Deel sales director visited the site to check out the game, engaged with a chatbot on the page, and then later saw the exchange posted on Twitter by the COO of Rippling. (More detail here.)Slack forensics played a major role in the suitWhat is quite notable in the lawsuit is just how much of the evidence for Ripplings claims is based around Slack activity. Ripplings lawyers note that the company keeps a log of what people do in the Salesforce-owned chat platform. Rippling employees Slack activity is logged, it notes, meaning every time a user views a document through Slack, accesses a Slack channel, sends a message, or conducts searches on Slack, that activity (and the associated user) is recorded in a log file.It was a sudden spike in that logged activity, and specifically how it centered around the word Deel that raised a flag to the (HR?) team that tracks that activity.Beginning in November 2024, [an employee referred to as] D.S. beginning [sic] previewing channels at a rate orders of magnitude greater than he had before both in terms of the number of channels previewed, and in the number of times he previewed each of those channels.The lawsuit states that many of these channels contained confidential sales and business strategy discussions, with particular emphasis on Deel.The channels D.S. previewed during this period have no connection to his payroll operations job responsibilities, states the complaint. What they do relate to, however, are all aspects of Ripplings business development, sales, and customer retention strategiesthe most sensitive of the Companys Sales and Marketing Trade Secrets and confidential business informationwith a particular emphasis on a single competitor, Deel.Leaving no doubt about the ultimate beneficiary of the brazen espionage scheme, D.S. viewed channels related specifically to Ripplings competitive intelligence concerning Deel over 450 times during the course of the scheme Indeed, D.S.s top 10 channel previews since November 2024 are all sales-related channels, completely unrelated to D.S.s role in payroll operations.The lawyers allege the employee also read and downloaded related exchanges and documents in those channels, and worked on helping try to poach people from Rippling.The drama is realAccording to the lawsuit, Rippling set up a honeypot to prove out its suspicions. The company created a fake Slack channel and shared its name with key Deel execs, then sat back to see if D.S. searched for it. (The execs included Deels Chairman, Chief Financial Officer, and General Counsel Philippe Bouaziz; Deels head of U.S. Legal, Spiros Komis; and Deels outside counsel.) He did, claims the lawsuit.Things got very heated afterward, per the filing, which says that when an independent solicitor attempted to seize D.S.s phone by court order, D.S. escaped to the bathroom, locking the door behind him and refusing to come out, despite the independent solicitors repeated warnings.Rather than comply, it goes on, D.S. was heard doing something on his phone by the independent solicitor, who also heard D.S. flush the toilet suggesting that D.S. may have attempted to flush his phone down the toilet rather than provide it for inspection. It did not recover the phone later.Eventually D.S. left the bathroom, says the complaint, and when confronted one more time with the threat that he was violating a court order, said Im willing to take that risk.D.S. then stormed out of the office and fled the scene, the lawyers note.Rippling has not responded to questions TechCrunch has sent asking if it intends to also file a suit against D.S. or whether it can confirm the name.But despite the company giving the alleged spy a set of initials, it has done precious little to hide his identity. Spelling out when the person joined, describing the person as he, and describing what role he had at the company made it almost too easy to find on LinkedIn the person it suspects of spying. (The person we contacted has since deleted his profile on the site.)

  • Microsoft Warns Windows UsersChange Your Browser As New Attacks Underway

    New warning issued for Chrome users.NurPhoto via Getty ImagesMicrosoft has just issued a new warning for Chrome users after discovering a sophisticated new attack that steals credentials stored in the browser, digital wallet information, data stored in the clipboard, as well as system information. The warning comes from Microsofts respected Incident Response team, but its an awkward one.The Windows-maker is on a mission to convert Chrome users to Edge, and this latest security warning does the same. Thats heightened given this attack specifically targets Chrome. To help prevent this type of malware from infiltrating the system and reduce the attack surface, Microsoft says, its best to use Edge and other web browsers that support SmartScreen, which identifies and blocks malicious websites, including phishing sites, scam sites, and sites that host malware.Microsoft has dubbed this novel remote access trojan StilachiRAT, and warns that it demonstrates sophisticated techniques to evade detection, persist in the target environment, and exfiltrate sensitive data. While the new RAT has not yet gained a substantial foothold, due to its stealth capabilities and the rapid changes within the malware ecosystem this could change. Thus the well-promoted warning.StilachiRATs capabilities are extensive, and include harvesting system information, targeting digital wallets and extracting security credentials. An attack can scan for configuration data of 20 different cryptocurrency wallet extensions for the Google Chrome browser, and can also extract and decrypt saved credentials from Google Chrome, gaining access to usernames and passwords stored in the browser.The added threat from StilachiRAT is mapping and moving across networks. It has been designed to monitor RDP sessions, capture active window information and impersonate users, allowing for potential lateral movement within networks. And as weve seen with other recent attacks, the RAT hides behind default Windows Services to dodge security scans and ensure persistence when machines are restarted.Microsofts campaign to lure Chrome users over the Edge has intensified this year, prompting Google execs to bite back. Against that backdrop, its always difficult for a security warning such as this to be seen as fully independent. Google will no doubt be plugging gaps behind the scene and will promote its own safe browsing credentials. I have asked the Chrome team for any thoughts on Microsofts new report.In addition to switching to Edge, Microsoft also advises only installing software from official websites, using Safe Links and Safe Attachments for Office 365 where available, and enabling network protection in Microsoft Defender for Endpoint to prevent applications or users from accessing malicious domains and other malicious content.While Microsoft has been pushing Windows users to the Edge, it has not yet yielded much of a result. Chrome continues to dominate the desktop market and is the de facto default browser on Windows one reason its in DOJs crosshairs. The integrated security defenses that come from Microsofts various solutions (as seen here), especially in an enterprise setting, still seem the best bet to drive conversions.

This immense leap in throughput will accommodate future data-intensive tasks, increased device densities, and provide improved connectivity for real-time applications.However, Wi-Fi 7 does not exclusively operate on the 2.4 GHz frequency band. The 2.4 GHz band remains important for long-range connectivity and compatibility with legacy devices, while the 5 GHz and 6 GHz bands deliver higher throughput and lower latency due to less congestion and interference.Beamforming technology and advanced modulation schemes, such as 4096-QAM (Quadrature Amplitude Modulation), further enhance Wi-Fi 7's efficiency and performance. Copilot has made it into Windows 11 (and even, to a more limited extent, the aging Windows 10) as a native app, and then a wrapper around a web app, and soon as a native app again.But this month's Windows updates are removing the Copilot app from some Windows 11 PCs and unpinning it from the taskbar, according to this Microsoft support document. This bug obviously won't affect systems where Copilot had already been uninstalled, but it has already led to confusion among some Windows users.Microsoft says it is "working on a resolution to address the issue" but that users who want to get Copilot back can reinstall the app from the Microsoft Store and repin it to the taskbar, the same process you use to install Copilot on PCs where it has been removed.Though some version of Copilot has been included in fresh Windows 11 installs since mid-2023, and Microsoft even added a Copilot key into the standard Windows keyboard in early 2024, Copilot's appearance and capabilities have shifted multiple times since then.The initial version could do typical chatbot things like have "conversations" and attempt to answer questions, but could also be used as a shortcut to perform certain tasks or change Windows settingsswitching between dark and light mode, taking screenshots, and toggling Do Not Disturb are all listed among Copilot's capabilities in Microsoft's original blog post announcing Copilot but are not supported in the current version of the app. (Recently, I had the bizarre experience of standing in a Best Buy, watching a promotional sizzle reel for Copilot playing on one of their display PCsthe problem was that the video was advertising capabilities that Copilot no longer had, using a version of the app that no longer exists.)While the next version of the Copilot app that Microsoft is testing is once again a native app rather than a web app, it still doesn't appear to integrate with Windows as deeply as that initial version did.
