  • TikTok ban seems highly likely after Supreme Court hearing, legal experts say

    On Friday, the Supreme Court heard oral arguments on the TikTok divest-or-ban law.TikTok asked the court to pause its divestment deadline, set for January 19.Legal experts expect the Supreme Court to uphold the law despite pressing the government on its case.TikTok is fighting for its life as it faces a US ban set to arrive in a little over a week. On Friday, it argued its case before the Supreme Court.The justices peppered attorneys on both sides with questions about a divest-or-ban law that compels TikTok's Chinese owner, ByteDance, to divest from the US version of TikTok by January 19 or be forced to shut the app down.Legal experts told Business Insider that TikTok's prospects remain dim.Matthew Schettenhelm, a litigation and policy analyst at Bloomberg Intelligence, said he thinks TikTok's chances of a Supreme Court rescue look slimmer after Friday's hearing. "I expect the court to deny the stay, probably soon, and also uphold the law," he told BI.Many of the back-and-forths in the hearing centered on whether a TikTok divestment was the only path to solving Congress's national security concerns and if the law violates the free-speech rights of TikTok and its users. TikTok's attorney asked why its company had been singled out in the law and why e-commerce platforms like Shein and Temu were granted exemptions.TikTok is appealing to the Supreme Court for a pause on its divestment deadline after it lost its case in the DC Circuit in December. But more time may not ultimately make much of a difference for the company.During oral arguments on Friday, TikTok's lawyer Noel Francisco said it would be "extraordinarily difficult" to divest its US platform from the rest of TikTok globally over any timeline.The attorney said divestment would be challenging because of the complexities of TikTok's algorithm and its reliance on interoperability with teams and creators in other countries.TikTok appears to be hoping for some type of political resolution that does not involve divestment, possibly brokered by President-elect Donald Trump.Alan Rozenshtein, a former Justice Department official and current University of Minnesota law professor, said the government "got hard questions in a way that it did not at the DC Circuit," but that doesn't mean TikTok will get a better outcome."I don't think that's going to be enough," Rozenshtein told BI. "I still think the most likely outcome is the law will be upheld."He gave an 80% chance that the Supreme Court would uphold the law.TikTok would 'go dark' if the court doesn't interveneAfter January 19, the company said it would "go dark" without court intervention as it would be pulled from app stores. Its service providers would also stop working with the company."It's essentially going to stop operating. I think that's the consequence of this law, which is why I think a short reprieve here would make all the sense in the world," Francisco, the TikTok lawyer, said.Still, like the DC Circuit, the Supreme Court is likely to show deference to Congress on questions of national security, even in instances where First Amendment rights are at stake."It's going to be an uphill battle," G.S. Hans, a clinical professor of law at Cornell Law School, told Business Insider ahead of the hearing. "TikTok lost 3-0 in the DC Circuit. They lost with a cross-ideological panel."He added: "If you're the company, you're hoping for a change of fortune. That's a tall order because of the general deference on natural security grounds to the political branches from the courts."Why is TikTok facing a ban?TikTok was included in the Protecting Americans from Foreign Adversary Controlled Applications Act, passed in April. The act sought to limit the influence of social apps with ties to countries the US deemed foreign adversaries to guard national security interests. ByteDance is headquartered in China, which the US government has called a foreign adversary.While members of both parties in Congress have raised alarm bells about TikTok, support for a ban among the American public has declined over the past couple of years. Support for a government ban fell from 50% in March 2023 to 32% in July and August among US adults who responded to Pew Research Center surveys.Donald Trump may try to save TikTok as president, as he pledged to do during his campaign run. Trump filed an amicus brief on December 27 asking the Supreme Court to pause the deadline for a TikTok divestment so he could try to negotiate a political resolution once in office.

I live near Rocky Mountain National Park, so I know of lots of hidden gems in the area.In the park, I recommend checking out the Holzwarth Historic Site and Alpine Visitor Center.Outside the park, it's worth visiting the picturesque Chapel on the Rock and the Stanley Hotel.Colorado's Rocky Mountain National Park, which spans 415 square miles, offers endless recreation opportunities. From watching the trees change colors in the fall to cross-country skiing in the winter, there's always something to do.However, I've noticed that many visitors tend to check out only a few popular areas in the park. Since Rocky Mountain is practically in my backyard, I've come across some less-busy treasures in and around the park that are worth exploring.Here are five hidden gems I think all tourists should check out when visiting Rocky Mountain National Park. Venture over to the west side of the park.The Colorado River begins in Rocky Mountain National Park. Emily Pogue I've found that the vast majority of Rocky Mountain National Park visitors only visit the east side of the park, particularly the Bear Lake area. In fact, I've gone on hikes on the west side and have only seen a handful of people over multiple hours.My favorite thing to check out on the west side is the Holzwarth Historic Site. Here, you can find a small village of log cabins, giving you an idea of what life looked like in the Rockies 100 years ago.However, what really makes this stop stand out is the creek you walk over to get to the site. Although it's easy to overlook, this stream is actually the beginning of the Colorado River.It's difficult to imagine that this babbling brook grows into the mighty river that carved out the Grand Canyon. For spectacular views, venture up to the Alpine Visitor Center.I love taking in the views from the Alpine Visitor Center. Emily Pogue If you're visiting in the warmer months, Trail Ridge Road is your lifeline through Rocky Mountain National Park. The main route through the park offers gorgeous views of the Continental Divide, mountain lakes, and wildlife.At the highest point on the road (11,796 feet above sea level), you'll find the Alpine Visitor Center. This is a great place to grab a coffee and look out over the expansive landscape below.You also have a good chance of seeing two fuzzy critters: marmots and pikas. Both are part of the rodent family and make for some great entertainment as you sip on a drink. After visiting the park, stop by the Chapel on the Rock.The Chapel on the Rock is officially known as the St. Catherine of Siena Chapel. haveseen/Shutterstock The Chapel on the Rock somehow feels completely out of place yet blends in perfectly with its surroundings.Located near Rocky Mountain National Park, the 90-year-old stone church almost startles you after seeing nothing for miles on the country highway leading up to it.Officially named the St. Catherine of Siena Chapel, visitors are able to enter the building to pray or learn about its history, which is fascinating in itself. In 1993, the chapel even hosted a very famous guest: Pope John Paul II.Although it's not a long stop, the Chapel on the Rock is a very unexpected landmark in rural Colorado. Check out the Stanley Hotel the inspiration for "The Shining."Stephen King and his wife stayed at the hotel in September 1974. Emily Pogue Estes Park is the mountain town just outside the main entrances to Rocky Mountain National Park. The downtown is lovely to stroll through filled with taffy stores and souvenir shops. However, the most famous landmark in the town is the Stanley Hotel.First and foremost, the Stanley is a luxury hotel complex, complete with restaurants, a whiskey bar, and a theater. The hotel opened in 1909 and has hosted its fair share of notable guests including Stephen King in September 1974.King and his wife Tabby were the only guests in the entire hotel, as the property was set to close up for winter the next day. This stay inspired his bestselling thriller, "The Shining."If you want to dive into "The Shining" lore and the hotel's ghost stories, you can book a special tour around the hotel grounds. However, if you don't have time for that, quickly stopping by to check out the beautiful buildings (and hedge maze out front) is well worth the time. Spend some more time outdoors at the YMCA of the Rockies.The YMCA of the Rockies offers day passes. Now, Capital One is in the crosshairs.Capital One is the subject of a lawsuit filed this week by creators, who allege the company's Shopping browser extension hurt their affiliate-marketing commissions by stealing credit for driving sales."We disagree with the premise of the complaint and look forward to defending ourselves in court," a Capital One spokesperson told Business Insider.Capital One Shopping is a free browser extension that searches for discount codes and coupons, compares prices across around 30,000 online retailers, and lets users earn rewards that can be exchanged for gift cards. It makes money by earning a commission when its users purchase an item from its merchant partners.In a class-action lawsuit filed on January 6 in a Virginia court, two creators who promote products on social media allege Capital One's Shopping browser extension is designed to "systematically appropriate commissions that belong to influencers."The lawsuit alleges Capital One Shopping "stole credit" by swapping out influencers' affiliate-marketing browser cookies with its own. Cookies are small data files stored on a user's device that help companies track users' browsing history.The war for the last clickMuch like recent lawsuits filed by influencers against PayPal over its Honey browser extension, the Capital One Shopping case hones in on the marketing practice of "last-click attribution."In this model, cookies, unique web links, promo codes, and other analytics tags are used to determine the last piece of content a user engages with before they make a purchase. That entity, be it a YouTube video or an ad, gets credit for the purchase.The practice has fallen out of favor in some marketing circles because it doesn't consider the full cycle of convincing someone to buy a product. There are also concerns that some middlemen may try to game the system to unfairly claim last-click credit for purchases that they had little to do with.Companies in the affiliate-marketing industry often seek to adhere to "stand down" practices, where they won't override another affiliate's cookies.In their lawsuit, content creators Jesika Brodiski and Peter Hayward allege Capital One Shopping took credit for sales and conversions that were originally derived from affiliate-marketing links they shared to social media.Brodiski shared affiliate-marketing links on social media for products on Walmart.com, and the lawsuit claims that if a user had the Capital One Shopping extension activated during the checkout process Capital One would remove her associated cookie and replace it with its own. The lawsuit said Brodiski earned around $20,000 through affiliate marketing in 2024 but that her earnings were hampered by Capital One Shopping. The lawsuit alleges that if users have the Capital One Shopping extension activated, Capital One can unfairly take credit for some sales. Jesika Brodiski and Peter Hayward, on behalf of themselves and all others similarly situated, Plaintiff(s), v. Capital One Financial Corporation, Wikibuy LLC, and Wikibuy Holdings LLC. Hayward is part of the Amazon affiliate-marketing program and similarly alleges Capital One would replace his referral tag with its own.The lawsuit also alleges Brodiski and Hayward "face future harm in the form of stolen referral fees and sales commissions because the Capital One Shopping browser extension continues to steal affiliate marketing commissions with each passing day."A court will need to certify the class action in order for the case to proceedThe plaintiffs are seeking a jury trial. If the case is certified as a class action, other influencers could join the suit.Christopher Roberts, partner and class-action attorney at the law firm Butsch Roberts & Associates, told BI the most difficult part of such cases is getting the class certified. The court will need to rigorously analyze various factors, such as whether the class is big enough and whether it would make more sense to litigate complicated cases individually.Certification aside, Roberts said he felt the case would come down to what discovery showed."This case, on its face, is very well-pled, and it's pretty specific as to the code for this app being supplanted on the computer so that they can get the affiliate payment," Roberts said.

    With Leigh Whannells Wolf Man about to howl its way into theaters, werewolves are hoping to become the next monster du jour after Nosferatu closed out the year with such vampiric heights. Get in the mood by watching one of the strangest werewolf movies ever, which is saying something for a genre that has some deeply weird entries: 1974s The Beast Must Die. Based on a 1950 short story with the equally alluring title There Shall Be No Darkness, The Beast Must Die has an Agatha Christie-type set-up, in which a group of people are invited to an isolated country manor under false pretenses, and realize theyre in for a sinister getaway complete with body count. Calvin Lockhart stars as Tom, a flamboyant millionaire whose hunting obsession has inspired him to pursue the ultimate game: a werewolf. Whether or not werewolves actually exist is only lightly questioned in the context of the movie; Tom is so obsessed with the idea hes invested tons of money into an elaborate werewolf-catching system. The grounds around his mansion are equipped with a high-tech (for 1974) surveillance system, which we see demonstrated in an opening sequence in which he tests its capabilitiesand the audience is led to believe Toms some kind of fugitive being tracked by a man barking orders from a control room to gun-toting security forces.But even before Tom terrifies his guests by bursting out of the forest with a small army chasing after him, we know The Beast Must Die is no ordinary country caper. Thats because the movie opens with some very specific exposition: This film is a detective storyin which you are the detective.Ok, cool. Participatory element, intriguing. But then: The question is not who is the murderer?but who is the werewolf? Who is the what now? After all the clues have been shown, you will get a chance to give your answer watch for the werewolf break. With the prospect of a werewolf break now percolating in the viewers mind, The Beast Must Die continues very much like an Agatha Christie tale, albeit one with a groovy, vaguely disco-flavored soundtrack. Tom explains in great detail to Pavel (Anton Diffring)the skeptical but good-natured security expert Toms hired to oversee all that fancy equipmenthis motivation behind this odd gathering, in a speech that includes the phrases I go after what I want, I was born a hunter, and this is going to help me hunt the biggest game of all. His guests for this adventure, which is not coincidentally timed around the full moon, include an array of disgraced eccentrics (a painter who admits to a flirtation with cannibalism; a former UN delegate whose associates just kept mysteriously disappearing), and, as Tom thunderously informs them, One of you sitting here in this room is a werewolf, followed by a dramatic music cue. One of you, in other words, is the beast thats gonna die.Horror legend and future Star Wars baddie Peter Cushing is second-billed as an archaeologist invited along because he happens to be a werewolf expert. Cushing plays it very seriously as he lectures the other guests about the oddities of wolfsbane pollen, which Lockhart goes agreeably over the top as he orders the increasingly uncomfortable group to take turns grabbing silver objects throughout the movie. The tense build-up pre-dates the blood test scene in John Carpenters The Thing but brings about a similar result.We know were going to learn the werewolfs identity eventuallyunfortunately, that marvelous CCTV system ends up not helping much when Pavel is the first victimbut as you get swept along with the fun of the various accusations (hmm, that one guy sure does have awfully hairy hands!), you might accidentally forget about the promised werewolf break. Fear not, though: The Beast Must Die, a title taken directly from one of Toms declarations, will not let you down. With about 15 minutes to go, and a few suspects removed from the line-up on account of having already been devoured, the narrator returns to tell you This is the werewolf break, as a ticking clock appears on the screen and you see images of all the suspects. You have 30 seconds to ponder who the culprit might bepresumably, youre to discuss your theory with whoevers watching the movie with you? Or scream your best guess into the void?before The Beast Must Die returns and gives you a false solution before the actual snarling cause of all the trouble is revealed.We wont spoil it, obviously, but the ending of The Beast Must Die is both surprising and satisfying. Yeah, it leans into a gimmick to get you to the finish line, but what other movie dares to bring everything to a screeching halt to declare a werewolf break? You can stream The Beast Must Die free on Tubi and a few other FAST channels; you can also rent it through Prime Video or watch with subscriptions to Shout! Factory TV and Fandor. ByteDance and a group of TikTok creators already lost their case in a lower federal court last month, which set the stage for the last-gasp appeal to the Supreme Court. The case is about a bipartisan law passed by Congress and signed by President Joe Biden earlier this year that would prohibit the TikTok app from operating in the U.S. unless ByteDance relinquishes control over its U.S. subsidiary. Intelligence officials and lawmakers have been raising the alarm about TikToks ownership for years, arguing that the companys addictive algorithm operate as a propaganda machine for the Chinese government and that the data the app collects about users threatens U.S. national security.U.S. Solicitor General Elizabeth Prelogar pressed those points on Friday, saying that the Chinese government could weaponize TikTok at any time by using the vast amounts of sensitive data the app collects to blackmail Americans or by using its influence over ByteDances proprietary algorithm to secretly manipulate the platform to advance its geopolitical goals.TikToks attorney, Noel Francisco, argued that the law was directly targeted at suppressing certain ideas and content and would therefore violate the free speech rights of TikTok Inc. (the American subsidiary company). Furthermore, he said, Congress had not considered less-restrictive options to prevent the Chinese government from accessing the data TikTok collects about U.S. users. The law will essentially force TikTok to shut down, he said, because selling the platform will be extremely difficult and even if another entity purchased the U.S. subsidiary it would not be able to use ByteDances proprietary recommendation algorithm that has made TikTok so popular. The case hinges on several core questions: Is a law prohibiting a publisher from being controlled by a foreign entity an impermissible restriction on protected speech? And if so, does Congress have a compelling enough national security argument for the law to survive the strict scrutiny standard the court has established for cases that pit national security against First Amendment protections? The project of House Seventeen emerged from the proposal to renovate an existing building, with the main objective being to redistribute the spaces to meet the clients' program requirements while retaining the original structure. The proposed program distributes the rooms through an "L"-shaped floor plan, where the private area is concentrated on one side of the house and the social area is spread along the opposite side, extending along the length of the site. The service area is concentrated at the front of the house, shielded from external visibility by slatted panels of natural wood.Save this picture!Save this picture!The master suite opens directly onto the pool area, which is bordered by the open-plan gourmet space, seamlessly connected to the garden. Wood, the protagonist element of the house's architecture, envelops both the external walls, composing the main facade, and the ceiling of the outdoor common area, through spaced and repeated beams that bring rhythm to the block.Save this picture!The presence of greenery is also a focal point of the project, aiming to connect nature and architecture in all areas of the house. On the front facade, a sloping beam clad in corten steel delineates the upper part of the main volume. A setback in this block marks the social entrance, flanked by a garden featuring a tree that intersects the void left by the design of that beam.Save this picture!In response to the clients' demands, a new block was constructed at the back of the plot to accommodate the playroom, which houses a spacious area dedicated to the games and activities of the couple's three children. Here, the architectural language follows that of the main block, with external claddings in slatted wood panels and large translucent glass windows, directly connecting the interior space to the garden, allowing play to flow freely between both spaces.Save this picture!The final result of the architectural project is defined in a practical, functional, and timeless house, whose aesthetics harmonize with the modernist and clean lines language of the city in which it is located.
