Deciding the fate of leftover embryos
This article first appeared in The Checkup,MIT Technology Reviewsweekly biotech newsletter. To receive it in your inbox every Thursday, and read articles like this first, sign up here. Over the past few months, Ive been working on a piece about IVF embryos. The goal of in vitro fertilization is to create babies via a bit of lab work: Trigger the release of lots of eggs, introduce them to sperm in a lab, transfer one of the resulting embryos into a persons uterus, and cross your fingers for a healthy pregnancy. Sometimes it doesnt work. But often it does. For the article, I explored what happens to the healthy embryos that are left over. I spoke to Lisa Holligan, who had IVF in the UK around five years ago. Holligan donated her genetically abnormal embryos for scientific research. But she still has one healthy embryo frozen in storage. And she doesnt know what to do with it. Shes not the only one struggling with the decision. Leftover embryos are kept frozen in storage tanks, where they sit in little straws, invisible to the naked eye, their growth paused in a state of suspended animation. What happens next is down to personal choicebut that choice can be limited by a complex web of laws and ethical and social factors. These days, responsible IVF clinics will always talk to people about the possibility of having leftover embryos before they begin treatment. Intended parents will sign a form indicating what they would like to happen to those embryos. Typically, that means deciding early on whether they might like any embryos they dont end up using to be destroyed or donated, either to someone else trying to conceive or for research. But it can be really difficult to make these decisions before youve even started treatment. People seeking fertility treatment will usually have spent a long time trying to get pregnant. They are hoping for healthy embryos, and some cant imagine having any left overor how they might feel about them. For a lot of people, embryos are not just balls of cells. They hold the potential for life, after all. Some people see them as children, waiting to be born. Some even name their embryos, or call them their freezer babies. Others see them as the product of a long, exhausting, and expensive IVF journey. Holligan says that she initially considered donating her embryo to another person, but her husband disagreed. He saw the embryo as their child and said he wouldnt feel comfortable with giving it up to another family. I started having these thoughts about a child coming to me when theyre older, saying theyve had a terrible life, and [asking] Why didnt you have me? she told me. Holligan lives in the UK, where you can store your embryos for up to 55 years. Destroying or donating them are also options. Thats not the case in other countries. In Italy, for example, embryos cannot be destroyed or donated. Any that are frozen will remain that way forever, unless the law changes at some point. In the US, regulations vary by state. The patchwork of laws means that one state can bestow a legal status on embryos, giving them the same rights as children, while another might have no legislation in place at all. No one knows for sure how many embryos are frozen in storage tanks, but the figure is thought to be somewhere between 1 million and 10 million in the US alone. Some of these embryos have been in storage for years or decades. In some cases, the intended parents have deliberately chosen this, opting to pay hundreds of dollars per year in fees. But in other cases, clinics have lost touch with their clients. Many of these former clients have stopped paying for the storage of their embryos, but without up-to-date consent forms, clinics can be reluctant to destroy them. What if the person comes back and wants to use those embryos after all? Most clinics, if they have any hesitation or doubt or question, will err on the side of holding on to those embryos and not discarding them, says Sigal Klipstein, a reproductive endocrinologist at InVia Fertility Center in Chicago, who also chairs the ethics committee of the American Society for Reproductive Medicine. Because its kind of like a one-way ticket. Klipstein thinks one of the reasons why some embryos end up abandoned in storage is that the people who created them cant bring themselves to destroy them. Its just very emotionally difficult for someone who has wanted so much to have a family, she tells me. Klipstein says she regularly talks to her patients about what to do with leftover embryos. Even people who make the decision with confidence can change their minds, she says. Weve all had those patients who have discarded embryos and then come back six months or a year later and said: Oh, I wish I had those embryos, she tells me. Those [embryos may have been] their best chance of pregnancy. Those who do want to discard their embryos have options. Often, the embryos will simply be exposed to air and then disposed of. But some clinics will also offer to transfer them at a time or place where a pregnancy is extremely unlikely to result. This compassionate transfer, as it is known, might be viewed as a more natural way to dispose of the embryo. But its not for everyone. Holligan has experienced multiple miscarriages and wonders if a compassionate transfer might feel similar. She wonders if it might just end up putting [her] body and mind through unnecessary stress. Ultimately, for Holligan and many others in a similar position, the choice remains a difficult one. These are very desired embryos, says Klipstein. The purpose of going through IVF was to create embryos to make babies. And [when people] have these embryos, and theyve completed their family plan, theyre in a place they couldnt have imagined. Now read the rest of The Checkup Read more from MIT Technology Review's archive Our relationship with embryos is unique, and a bit all over the place. Thats partly because we cant agree on their moral status. Are they more akin to people or property, or something in between? Who should get to decide their fate? While we get to the bottom of these sticky questions, millions of embryos are stuck in suspended animationsome of them indefinitely. It is estimated that over 12 million babies have been born through IVF. The development of the Nobel Prizewinning technology behind the procedure relied on embryo research. Some worry that donating embryos for research can be onerousand that valuable embryos are being wasted as a result. Fertility rates around the world are dropping below the levels needed to maintain stable populations. But IVF cant save us from a looming fertility crisis. Gender equality and family-friendly policies are much more likely to prove helpful. Two years ago, the US Supreme Court overturned Roe v. Wade, a legal decision that protected the right to abortion. Since then, abortion bans have been enacted in multiple states. But in November of last year, some states voted to extend and protect access to abortion, and voters in Missouri supported overturning the state's ban. Last year, a ruling by the Alabama Supreme Court that embryos count as children ignited fears over access to fertility treatments in a state that had already banned abortion. The move could also have implications for the development of technologies like artificial uteruses and synthetic embryos, my colleague Antonio Regalado wrote at the time. From around the web Its not just embryos that are frozen as part of fertility treatments. Eggs, sperm, and even ovarian and testicular tissue can be stored too. A man who had immature testicular tissue removed and frozen before undergoing chemotherapy as a child 16 years ago had the tissue reimplanted in a world first, according to the team at University Hospital Brussels that performed the procedure around a month ago. The tissue was placed into the mans testicle and scrotum, and scientists will wait a year before testing to see if he is successfully producing sperm. (UZ Brussel) The Danish pharmaceutical company Novo Nordisk makes half the worlds insulin. Now it is better known as the manufacturer of the semaglutide drug Ozempic. How will the sudden shift affect the production and distribution of these medicines around the world? (Wired) The US has not done enough to prevent the spread of the H5N1 virus in dairy cattle. The response to bird flu is a national embarrassment, argues Katherine J. Wu. (The Atlantic) Elon Musk has said that if all goes well, millions of people will have brain-computer devices created by his company Neuralink implanted within 10 years. In reality, progress is slowerso far, Musk has said that three people have received the devices. My colleague Antonio Regalado predicts what we can expect from Neuralink in 2025. My family of 4 went to Maggiano's for the first time, and our $230 dinner at the chain felt like an incredible value
Right off the bat, Maggiano's felt high-end and intimate. In some ways, Maggiano's reminded me of when I used to visit Little Italy in Baltimore. Terri Peters On the outside, the restaurant's black awning with simple lettering felt elegant and welcoming.Inside, Maggiano's ambiance reminded me of a high-end, pricey steakhouse or an authentic Italian restaurant. The candle-lit, chandelier-dotted interior felt quite intimate and cozy.I didn't feel like I was in a chain restaurant at all. In fact, it reminded me of when I used to live in Baltimore and visit its Little Italy neighborhood for dinner. The restaurant has a family-style menu, but we chose to order individual dishes. The Maggiano's menu was pretty easy to navigate. Terri Peters The restaurant offers a family-style menu with shareable courses, including starters, an entre, a pasta dish, and a dessert. It seemed like a decent deal for about $50 a person. However, everyone in my party had specific cravings and wanted pasta, so we ordered from the regular menu instead. We started the meal with a round of drinks. We spent a decent amount of money on drinks at Maggiano's. Terri Peters To start off the meal, my husband ordered a Negroni ($9) while my teenagers and I stuck with sodas and iced tea ($5 each).Later in the meal, my husband ordered an $18 glass of wine to go with his pasta, followed by a $5 cup of coffee with dessert. He spent way more on drinks than others in our group over $30 but the three of us were content with our free refills.A complimentary bread course came out soon after we were seated. At Maggiano's, a bread service was complimentary with our meal. Terri Peters Soon after we were seated, we were brought a basket of fresh, warm ciabatta bread and oil with herbs for dipping. The bread was delicious, and we were served so many pieces that we even had some left to take home. For our appetizer, we shared fried mozzarella. My family enjoyed the fried mozzarella at Maggiano's. Terri Peters We started our meal by sharing the fried mozzarella for $16.The crisp planks of battered and fried cheese were topped with melted mozzarella and served with a tomato dipping sauce.Everyone at my table enjoyed this tasty appetizer, which felt like an elevated take on mozzarella sticks. My daughter also got a bowl of creamy tomato soup as an appetizer.Maggiano's tomato soup came with tasty croutons. Terri Peters Topped with tasty croutons, Maggiano's tomato soup ($10.50) was a great starter for my soup-loving daughter. She really enjoyed it and even let me try a few bites. The creamy soup tasted perfectly tangy and seasoned with just enough salt to make each bite perfect.I tried one of Maggiano's signature pasta dishes.Maggiano's Rigatoni D pasta seemed to be pretty popular online. Terri Peters Before visiting any chain, I love checking out the dishes that have copycat recipes on social media. I found a lot of people making copycat versions of Maggiano's Rigatoni D pasta on TikTok, so I ordered it.The dish includes rigatoni mixed with roasted chicken, mushrooms, caramelized onions, and marsala cream sauce. It was really good, and I can see why TikTokers recreate the $28.50 dish. The generous portion size meant I took some of the pasta home. Fortunately, it was as delightful leftover as it was served fresh. My daughter also chose a rigatoni dish for her meal.My daughter enjoyed the spicy vodka sauce. Terri Peters One of Maggiano's newer menu items is rigatoni alla vodka ($26.50), a combination of rigatoni, Calabrian chiles, caramelized onions, and vodka sauce. My daughter added grilled chicken to the dish for an additional $8.50.We're big fans of pasta with vodka sauce and make it at home often even so, Maggiano's version of the dish held up.This creamy pasta was really delicious, especially when eaten leftover the next day.My son ordered classic spaghetti and meatballs. My son enjoyed the spaghetti and meatballs at Maggiano's. Terri Peters My son is a picky eater, so he kept his order simple with spaghetti and meatballs. His $25.50 spaghetti dish was really good. It was full of classic Italian flavors, with tangy tomato sauce and hearty meatballs. He had no complaints and also came home with leftovers. Lastly, my husband chose a carbonara with lobster.Maggiano's lobster carbonara cost us $39. Terri Peters Another fan-favorite dish at Maggiano's is lobster carbonara ($39), a blend of lobster, smoked bacon, sugar snap peas, white-wine truffle cream sauce, Parmesan, and spaghetti.TikTok is also full of copycat recipes for this pasta dish, so we expected it to be pretty impressive. After all, what's not to love about creamy sauce, pasta, bacon, and lobster? My husband thoroughly enjoyed this generously portioned dish. Although I couldn't try it due to a shellfish allergy, he said it was everything he'd want from a carbonara, with just the right hints of creamy sauce and carb-y spaghetti to soak it all up.Maggiano's also had my favorite dessert and it tasted wonderful. We finished our meal with dessert at Maggiano's. Terri Peters Crme brle is my favorite dessert, so I'm sure to order it whenever it's on a menu. We were incredibly full from our evening of bread, fried cheese, and pasta, so we decided to share one $12.50 order of it.I'm glad we shared because this dessert felt huge, just like the pasta dishes we had earlier. It was easily double the size of any crme brle I've had in a restaurant. It was also delicious. As full as I was, I couldn't help but go back for bite after bite of this creamy, sugary, warm treat. Maggiano's impressed us more than other high-end dining chains have. Our meal felt just as high-end and high quality as meals we've had at nice steakhouse chains. Terri Peters Our $230 dinner (including tax and before tip) included lots of drinks, a complimentary bread service, an appetizer, four giant pasta dishes, and a dessert.Overall, it felt like a great value, and the atmosphere at Maggiano's rivaled any high-end chain we've visited. We spent less on our meal here than we would at most steakhouse chains, but our dining experience felt just as high-end and high-quality.Our table felt intimate and we were able to chat with our teenagers and have a great dinner together, something that's just as valuable to my husband and I as the food these days.To save money next time, we might share dishes since the portion sizes are huge. I'd also consider coming back just to sit at the bar and have crme brle for dessert.Based on my experience, I'd definitely return to Maggiano'sand add it to thelist of chain restaurants I'd visit with family again and again.

Biden just announced there’s a new constitutional amendment. Huh?
Three days before leaving office, President Joe Biden has made a surprising announcement: He declared that a decades-old proposed Constitutional amendment enshrining equal rights on the basis of sex is now the law of the land.Except it isnt.A senior administration official told CNN that Biden was not taking executive action but merely stating an opinion that the Equal Rights Amendment (ERA) was in effect. The National Archives the federal government agency that is the official keeper of the Constitution has stated for years that they cannot legally publish the amendment, because theyre bound by a Department of Justice holding that says they cant. Plus, Donald Trump is about to take office and will likely express a different opinion.Whats going on?The Equal Rights Amendment, which states that equality of rights under the law shall not be denied or abridged by the United States or by any state on account of sex, was overwhelmingly approved by Congress in 1972 and sent to the states for ratification. Congress originally set a deadline of 1979 for ratification; it was later extended to 1982.That deadline came and went without enough states voting to ratify, and the understanding from the political and legal establishment has generally been that the ERA was dead. But progressive advocates have for years been trying to use some creative but dubious legal arguments to claim that enough states actually have ratified the ERA and it should go into effect. Some states voted to ratify the ERA after the deadline passed, and advocates claim that the deadline as well as the fact that some states also rescinded their ratification should simply be ignored. An existing DOJ opinion (issued during Trumps first term) held that the deadline has legal force, but advocates have argued that Biden should simply reject that opinion and just make it law. With his new announcement, Biden is in a sense giving advocates what they want sort of. Advocates had urged him to instruct the National Archives to publish the amendment and make it officially part of the Constitution, a move that would provoke a legal battle. But Biden is not going that far. Hes just, his aides claim, stating his opinion. So its unclear whether this will lead to anything at all.Everyone knows the deadline for approving the Equal Rights Amendment expired decades ago. What this legal argument presupposes is, maybe it didnt. For a proposed amendment to go into effect and officially become part of the Constitution, three-quarters of state legislatures 38 of 50 states need to ratify it. And, in 2020, Virginia became the 38th state to do so for the ERA.But there are two problems. First, only 35 not 38 states had ratified the ERA by the time the deadline set by Congress hit in 1982.Second, five of those states who ratified had subsequently voted (before the deadline) to rescind their ratifications which, if respected, would cut the number of ratifying states down to 30. (Initially, the amendment had broad bipartisan support, but a backlash from conservatives brewed as the 1970s went on and turned Republicans against it.)It has long been taken for granted that the deadline killed the ERA. But progressive advocates and legal experts came up with an idea: what if we simply ignore the deadline? (The technical argument is that Congress did not make the deadline part of the amendments text, so therefore, it is extraneous and should be ignored despite Congresss extremely clear intent.) These experts also say states lack the power to un-ratify an amendment theyve approved. So in the past few years, two more Democratic state legislatures gradually approved the amendment. And in 2020, Virginia became the 38th to do so, bringing it to the magic number if, again, you ignore the deadline and the five states that rescinded approval. But that year, Trumps Justice Departments Office of Legal Counsel issued an opinion that Virginias approval didnt matter, because the congressional deadline was real and binding. (They did not resolve whether states can rescind ratification.) The battle to make Biden and his appointees declare the ERA in effectOnce Biden took office, however, progressive womens rights advocates urged Biden to override that DOJ opinion; but for years, neither Biden nor his DOJ did so. And Bidens appointee to head the National Archives, Colleen Shogan, said that given the DOJs opinion, it would be illegal for her to publish the amendment and make it law.Kamala Harriss defeat and Bidens imminent departure from office spurred a renewed push from activists, who hoped Biden would see this as a legacy-making opportunity and would feel newly emboldened to defy political and legal caution.Sen. Kirsten Gillibrand (D-NY) took up the charge, arguing that Biden should cement his legacy as a defender of womens rights by instructing Shogan to disregard DOJs guidance and publish the amendment. Advocates have also argued that Shogan should simply do it herself, but last month, Shogan again asserted that it would be illegal for her to do so. Now, three days before leaving office and five full years after Virginia became the 38th state to approve the ERA by advocates optimistic math Biden has in one way acceded to progressives demands by asserting the ERA is the law of the land. However, importantly, Biden is not directly instructing Shogan to publish the amendment, which is what the advocates were actually asking him to do.If Biden had actually been serious about fighting and trying to win a legal battle to make this amendment go into effect, he surely would have begun that battle long before the imminent end of his term. Still, with the announcement, Biden did succeed in passing the hot potato to make Shogan look like the bad guy for trying to follow the law. The pressure is on; already, in December, Kate Kelly of the Center for American Progress told the New York Times that Shogan was an unelected appointee who is making it her job to keep women and queer people out of the Constitution. One way or another, this push seems headed for defeat. Even if Shogan has an about-face and the National Archives made the amendment official before Trump came in, a legal fight would soon ensue to determine whether that could stand a fight that would ultimately be decided by a very conservative Supreme Court. And even if the Court surprisingly let the amendment stand, that same Court would be in charge of interpreting what its broad principle means and theyd likely define it quite narrowly. So all this seems like something between an empty stunt and a doomed last stand. There will be many important and meaningful battles ahead to protect womens rights under the Trump administration but this isnt one of them.Youve read 1 article in the last monthHere at Vox, we're unwavering in our commitment to covering the issues that matter most to you threats to democracy, immigration, reproductive rights, the environment, and the rising polarization across this country. Our mission is to provide clear, accessible journalism that empowers you to stay informed and engaged in shaping our world. Greta Gerwigs Netflix Narnia Movie Is Getting a Big-Screen Release
While the world waits to see if Barbie 2 will ever come to pass, the director and co-writer behind that billion-dollar sensation is quietly making power moves in other cinematic realms. Weve known for awhile that Greta Gerwig is spearheading Netflixs Chronicles of Narnia reboot, but a new report reveals the C.S. Lewis adaptation will get an IMAX showcase before it arrives on the streamer. According to Puck News, Gerwigs Narnia movie will hit about 1,000 IMAX screens worldwide on Thanksgiving Day 2026 and will not appear on Netflix until Christmas, with a two-week IMAX run guaranteed and an option to add a third if theres enough audience interest. Also, theres a chance Narnia might also play in some non-IMAX theaters ahead of its streaming debut. In addition, Netflix has committed to market the IMAX release like a typical theatrical tentpole movie and identify Narnia as a Netflix/IMAX title from the outset. Puck reports this deal came about in spite of Netflixs well-known preference against showing its movies theatricallyunless said showing is in service of drumming up awards nominationsbecause co-CEO Ted Sarandos realized the importance of placating the Oscar-nominated Gerwig, whose films besides Barbie include Little Women and Lady Bird. She also co-wrote Disneys upcoming live-action Snow White. The outlet points out that the 1,000 IMAX screens for two weeks is a wider and longer release than a similarly high-profile Netflix productionRian Johnsons Glass Onion: Knives Out Mysteryreceived back in 2022, and wonders if perhaps more big-name directors will follow Gerwigs example and push Netflix for similar deals. (You have to guess fans sure wouldnt mind a similar release strategy for Guillermo del Toros Frankenstein, which is slated to hit the streamer at some point this year.)Are you excited to see Gerwigs Narnia on the big, big screen in 2026or will you wait a few weeks more to stream it on Netflix?
