Epic Games v. Apple: the fight for the future of the App Store
Today, An hour agoJay PetersNew App Store details from Phil Schiller testimony.Schiller wasnt sure if Apple would be allowed to charge a fee for in-app purchases made through alternative payment methods following Judge Yvonne Gonzalez Rogerss Epic v. Apple ruling, according to the Associated Press. Ultimately, Apple instituted the fees.Top Apple exec concedes he had doubts about app store fees imposed on alternative payment options[apnews.com]Sep 30, 2024Sean HollisterTim Sweeney says his Epic lawsuits are all about freeing the youth:We want our kids to grow up in a world thats better than this one. I grew up in an awesome world for developers and opportunity, the early days of Apple II computers and PCs, and anybody growing up, coming of age in this industry right now, is best case going to be an Apple and Google serf. That has to change. That must change. Not surprising to hear the man behind Nineteen Eighty-Fortnite say this, but it really does encapsulate his war with the tech industry. More on the latest lawsuit here.Sep 28, 2024Wes DavisApples homework is due Monday no matter what, says judgeImage: Cath Virginia / The VergeApple, the most valuable company in the world, will have to work this weekend to meet a legal deadline on Monday. Thats after Magistrate Judge Thomas S. Hixson on Friday denied the companys request for more time to produce 1.3 million documents related to App Store changes it made in January to comply with a 2021 court order.Judge Yvonne Gonzalez Rogers, who presided over the Epic lawsuit that resulted in those changes, told Apples legal team on May 31st it would need to produce all documents related to how it decided the new App Store rules after Epic challenged them. Document discovery was then referred to Hixson, who quoted part of a transcript from the hearing when he set Mondays deadline back in August:Read Article >May 28, 2024Lauren FeinerWhy Epics lawsuit against Apple just wont quitImage: Cath Virginia / The VergeIn 2020, Epic Games sued Apple for antitrust violations. Its been years since the trial wrapped and judgment was rendered, but for the past few weeks, Apple and Epic Games have been back in front of Judge Yvonne Gonzalez Rogers once more. Gonzalez Rogers mostly ruled in favor of Apple last time. Things might not go so well for the company this time.As a reminder, this whole case got started when Epic challenged Apples up to 30 percent fees to developers for in-app purchases through a splashy campaign where it basically ignored Apples App Store guidelines and put in its own mobile payment processing system in its popular game Fortnite. That got the Fortnite app kicked off of the App Store, setting up the perfect scenario for Epic to sue Apple over its rules. Apple filed a countersuit, accusing Epic of breaching its contract.Read Article >May 11, 2024Wes DavisOnly 38 of 65,000 developers have applied for Apples outside payment links.Epic argues that the 27 percent fee Apple charges third-party developers violates a 2021 court order to allow outside payment links. In this instance, Judge Yvonne Gonzalez Rogers has ordered an evidentiary hearing for May 8th to explore whether Apple is failing to abide by this Courts injunction, which requires it to implement certain practice changes relative to in- and out-of-app purchases.Apr 13, 2024Wes DavisApple files its response to Epics latest court accusations. In a 37-page filing (PDF) yesterday, Apple accused Epic of asking the court to micromanage its business operations to Epics advantage, and insisted that its new fee structure is fair and competitive in view of the substantial value Apple provides to developers.Epic accused Apple in March of violating a 2021 ruling requiring it to let app developers link to outside payments.Apple denies violating US court order in Epic Games lawsuit[Reuters]Mar 13, 2024Wes DavisEpic asks judge to enforce the Apple App Store injunctionIllustration: Alex Castro / The VergeEpic Games isnt done with Apple. A 2021 ruling forced Apple to allow developers of App Store apps to link to outside payments, and Epic has now filed a motion asking Judge Yvonne Gonzalez Rogers to enforce her original order.Epic says Apples updated developer policy that still reserves 27 percent of outside payments (or 12 percent for small developers) for Apple itself is still unjustified. Epic argues these fees are essentially the same as those the company charges for using its payments system.Read Article >Mar 6, 2024Jon PorterApple kills Epics iOS game store plans over App Store criticismIllustration by Alex Castro / The VergeEpics plans to release its own third-party app store on iOS in the EU could be in trouble after Apple terminated the developer account it planned to use. It cites Apples contractual right to terminate its Developer Program License Agreement with the company at Apples sole discretion.Read Article >Jan 31, 2024Wes DavisEpic preps its challenge to Apples bad-faith outside payments changesIllustration by Nick Barclay / The VergeEpic is not pleased with how Apple has responded to court orders. It thinks Apples new 27 percent tax on developers that link to non-Apple payment methods defies a court order to let developers provide those links and yesterday notified the court that it plans to lay out exactly how.To refresh, District Court Judge Yvonne Gonzalez Rogers ordered Apple in 2021 to let developers link to outside payment methods, and it immediately appealed (despite having called it a resounding victory). Apples final appeal of the court order was denied earlier this month, and the company was forced to change its tune on in-app payments. But it barely did so the 27 percent commission isnt much less than Apples 30 percent in-app payments fee, while other requirements for allowing outside payment links are so onerous that developers may not want to do so. For instance, developers will have to create transaction reports for Apple every 15 days so the company can make sure its getting its money.Read Article >Jan 24, 2024Emma RothApple thought it dealt with Epic v. But its solution is being met with backlash.Apple is giving developers the green light to send app users outside the built-in iOS payment system for the first time, following the instructions of a California court ruling in 2021. A bargain, if you ask Apple:Although it would be reasonable for Apple to seek the total amount of its Losses in this matter, it has provided a 10% discount in recognition of Epics win on one out of ten of its claims. This 10% overall reduction is extremely generous, given the undisputed fact that the UCL claim did not constitute nearly 10% of the litigation, as this Court recognized.Meeeoooow.Attorney Fees #876 in Epic Games, Inc. v. Soon after the Epic Games v. Apple ruling was issued, Epic appealed, and on January 27th, a large number of organizations filed amicus briefs in support of Epics battle, including a coalition of 35 state attorneys general, Microsoft, and the Electronic Frontier Foundation (EFF).During the fight, Epic was trying to make the case that Apple has a monopoly over iOS apps, and was asking for changes that would effectively force Apple to take a smaller percentage of all the transactions that go through that store. If Epic were successful in pushing Apple to accept alternate payment processors, for instance, it could dramatically change how Apple, the most profitable company in the world, operates its highly lucrative App Store. In the original case, the judge ultimately ruled in favor of Apple in nine of ten counts Epic brought against it, but both Epic and Apple appealed the parts that they lost.Read Article >Jan 20, 2022Russell BrandomEpic pushes to overturn App Store ruling in opening appeal briefIllustration by Alex Castro / The VergeEpic Games has filed its opening brief to the Ninth Circuit Court of Appeals, seeking to overturn the previous ruling that Apples control over the iOS App Store does not qualify as a monopoly. Upcoming New DC Movies and TV Shows: 2025 Release Dates and Beyond
A lot is changing for DC's lineup of movies and shows in the years ahead. James Gunn and Peter Safran, co-CEOs of DC Studios, have a strategy for a more cohesive and interconnected lineup of content moving forward. It all starts with Chapter 1, dubbed "Gods and Monsters."It can be very difficult to keep track of all the big changes at DC these days. And Gunn is always dropping updates and news it seems! That's why we've put together this comprehensive list of everything currently in the works, as well as the major projects that have either been officially canceled or gone dormant.Come join us in the reborn DC Universe. Click on through the slideshow below for a glimpse or read on for even more details...What Are the Next DC Movies Coming Out? 2025 Release DatesDC Universe: Every Upcoming Movie and TV ShowFor those keeping track, here's the full lineup of upcoming DC movies and TV shows:Superman (July 11, 2025)Peacemaker Season 2 (August 2025)The Sandman Season 2 (2025)Supergirl: Woman of Tomorrow (June 26, 2026)Clayface (September 11, 2026)Sgt. The film will explore Clark's struggle to balance his Kryptonian heritage with his Kansas upbringing and deal with the challenge of being a kind hero in an unkind world. The film is shaping up to be one of the first and most important entries in the revamped DCU line. David Corenswet stars as Superman, Rachel Brosnahan is Lois Lane and X-Men: First Class' Nicholas Hoult plays Lex Luthor.Peacemaker Season 2 (August 2025)Every New DCEU Character According to PeacemakerNot everything is being completely rebooted for the new DCU. James Gunn's Peacemaker is getting an Amanda Waller spinoff series as well as a second season. We don't know much about Season 2 yet, though Gunn did tease a mystery character on social media in October, 2024. We also know that Frank Grillo's Rick Flag, Sr., previously seen in Creature Commandos, will be an antagonist on the show. The Sandman Season 2 (2025)PlayDespite widespread critical acclaim and what appears to have been a very successful debut on Netflix, it took several months for the streamer to announce that The Sandman was renewed. Netflix did finally confirm that new episodes are in the works, though they shied away from describing it as "Season 2" initially. That may suggest Netflix plans to release new episodes in smaller batches, similar to how Season 1 was followed up by the surprise release of an eleventh episode. No matter the case, Season 2 will be the last for the show. Netflix says that was the plan even prior to abuse allegations against creator Neil Gaiman going public.Supergirl: Woman of Tomorrow (June 26, 2026)PlayThe new DCU will also have a new Supergirl. Supergirl: Woman of Tomorrow is a movie based on Tom King and Bilquis Evely's comic of the same name. This Supergirl is one who spent much of her early life living on a fragment of Krypton that was dislodged in the planet's destruction, what Gunn describes as a "horrible situation where she watched everybody around her die." House of the Dragon's Milly Alcock plays Supergirl, and Craig Gillespie (I, Tonya, Cruella) directs the film.Clayface (September 11, 2026)A Clayface movie scripted by Mike Flanagan is moving fast at DC. Flanagan (The Haunting of Hill House, Doctor Sleep, etc.) previously voiced a desire to make a Clayface movie as a "horror/thriller/tragedy." However, due to his various TV commitments, he won't direct the film, with Speak No Evil's James Watkins expected to direct for a Fall, 2026, release. Safran and Gunn promise a body horror picture that is R-rated as well.Given Deadline's previous report that Clayface is one of the major villains debuting in The Batman Part II, and the fact that the Clayface movie is being produced by Matt Reeves and Lynn Harris' 6th & Idaho Productions, it had been assumed that this movie would be set in The Batman universe rather than the DCU. But Gunn has since said that it is in fact unrelated to The Batman Epic Crime Saga and is definitely part of the DCU. Presumably, those earlier reports of the character being in The Batman Part II will wind up not panning out at this point.Sgt. Rock (Fall 2026)Reports in Nov. 2024 emerged that ex-James Bond star Daniel Craig himself was in talks to star in Sgt. Rock, and not just that but Oscar-nominated director Luca Guadagnino would be directing. The pair worked together on the A24 film Queer, and Guadagnino (Call Me By Your Name, Suspiria, Challengers) isn't exactly the first name you'd expect to hear for a Sgt. Rock movie. Exciting!More recently, Gunn has said that Craig is not involved in the film but that the studio is currently looking for an actor to play the title role, with an eye to shooting in Summer 2025 for a Fall 2026 release. The Batman Part II (October 1, 2027)PlayOf course The Batman Part II is in the works with Matt Reeves returning to write and direct and Robert Pattinson putting on the cape, cowl, and eyeliner (!) again as the Dark Knight Detective. The film is confirmed to have survived the recent turmoil at Warner Bros. Discovery, and Reeves has even signed a multi-year first-look deal with the studio. There's no word yet on what it will be about, so begin your Joker speculation now. The release date of the film has been pushed a couple of times now, first from October 2025 to October 2026, and then to October 2027.James Gunn has also confirmed that Pattinson will not be the DCU's version of Batman.Dynamic Duo (Animated Robin Origin Movie) (June 30, 2028)According to James Gunn, Dynamic Duo will tell the origin story of not one but two Robins -- Dick Grayson and Jason Todd. The film will be directed by Arthur Mintz, who's making the picture with his new animation studio Swaybox using a mix of animation, puppetry, CGI, and live-action performance. Huh.Lanterns TV Series (In Production)We're finally getting that oft-promised Green Lantern show. Lanterns is a high-concept detective drama in the vein of True Detective that revolves around Hal Jordan and John Stewart. Kyle Chandler (Friday Night Lights) has been cast as Hal and Aaron Pierre (The Underground Railroad) has been cast as John. The Brave and the Bold (In Development)PlayDC has confirmed that we'll have two cinematic versions of Batman going forward, as the DCU will get its own Dark Knight alongside the standalone movies of Matt Reeves' The Batman series. The Brave and the Bold looks to deal with the full Bat-family, centering specifically on Bruce Wayne's 10-year-old son Damian. The movie will draw heavily from Grant Morrison's Batman comics. It is unclear how the film will connect to the events of The Flash movie, if at all (probably not?), but that film's director, Andy Muschietti, was at one point confirmed to be directing The Brave and the Bold.More recently, it seems that Gunn and Safran have put some distance between the project and Muschietti, with Gunn taking point on it. Everybody knows I love Batman and its important to me so Im working very closely with the writer on Brave and the Bold, he told a group of reporters in February, 2025. Once the script is completed (it is not currently known who the writer is), Gunn and Safran said they will take it to Muschietti "and see if it's a fit for him."Creature Commandos Season 2 (In Development)PlayJames Gunn's latest band of misfit superheroes, the Creature Commandos, kicked off the new DCU with the first season of their animated series on Max, and a Season 2 is already in the planning stages. What the new version of the team will look like remains to be seen, though the Creature Commandos Season 1 finale did give us some hints...The Authority (In Development)DC's anti-Justice League were a big part of the initial announcement line-up that Gunn and Safran made back in 2023, but it seems like the project has been a tougher script to crack than they expected. The Authority is a group of powerful heroes who take a far more proactive approach to meting out justice, but Gunn said in February, 2025, that it's been the one that's been the hardest, both because of the shifting overall story and because of getting it right in a world with The Boys and a world with all the things that The Authority influenced that came out after it. The project is now on the back burner, he says.Swamp Thing (In Development)Swamp Thing may not have found much success on the short-lived DC Universe app, but DC was betting big on this lumbering monster for their new cinematic universe when they announced their plans for the new movie slate in 2023. The Swamp Thing movie was to explore the dark origins of Alec Holland's monstrous alter ego, with Logan and Indiana Jones 5 director James Mangold writing the script for the film. However, more recently Gunn and Safran have said that Swamp Thing hasn't had much movement as Mangold was working on his Bob Dylan movie, A Complete Unknown. "We hope that he'll come back to Swamp Thing when he's ready, because again, that was one of those ones that we love him as a filmmaker, so we're happy to wait for him," said Safran. The Samsung 990 Evo Plus 2TB SSD Is On Sale Today: Great for PS5 and Gaming PCs
Samsung's newest SSD - the Samsung 990 Evo Plus 2TB PCIe 4.0 M.2 NVMe solid state drive - is on sale today. Right now you can get it for $129.99, which is actually lower than what I saw during Black Friday. It's currently $40 cheaper than the Samsung 990 Pro and most (if not all) gamers won't notice the difference in performance.Samsung 990 Evo Plus 2TB PS5 SSD for $129.99Samsung 990 Evo Plus 2TB PCIe Gen 4x4 M.2 SSDThe Samsung 990 Evo Plus is an excellent drive for both your gaming PC and your PlayStation 5 console. It exceeds Sony's minimim speed recommendation for the PS5, boasting sequential speeds of up to 7,250 read and 6,300MB/s write. This is a much faster drive than the 990 Evo non-Pro but not quite as fast as the 990 Pro. The main difference between this drive and the more expensive 990 Pro is that this is a DRAM-less drive. For PS5 performance, it makes no difference. For gaming PCs, the 990 Evo Plus supports HMB (host memory buffer), which makes up for the lack of DRAM by using an inconsequential amount of RAM from your system memory. Gamers will not notice any difference between the two.The Samsung 990 Evo Plus does not have a preinstalled heatsink. However, the 990 Evo Plus SSD is a newer single-sided SSD design that is power efficient and doesn't generate as much heat as SSDs from before. That means you probably don't need to use a heatsink and it should still work perfectly fine in a PS5 console without any thermal throttling. That said, you certainly could for peace of mind and I wouldn't see any disadvantage to that aside from spending an extra $7.More SSDs for PS5Looking for more options? Alleged Leader of Rokos Basilisk Murder Cult Says She Did Nothing Wrong, and Would Appreciate Some Vegan Food in Jail
After being arrested in connection with a years-long, country-spanning string of murders, the alleged leader of a "Roko's Basilisk" cult is insisting she hasn't done anything wrong and that she should be granted access to a vegan diet.As theSan Fransisco Chronicle reports, Jack "Ziz" LaSota spoke ramblingly during her Maryland bail hearing last week that occurred after two young alleged "Zizians" were apprehended for a pair of slayings that took place in California and Vermont."I havent done anything wrong," LaSota told a judge during the February 18 hearing. "I shouldnt be here."A militant vegan whose animal rights beliefs are at the center of her writings as does the concept of "Roko's Basilisk," a hypothetical artificial superintelligence that would retroactively torture anyone who didn't help it come into existence the 33-year-old former tech worker also begged Judge Erich Bean, the jurist presiding over her hearing, to give her food she could eat."I must... I might starve to death," Ziz told the judge. "I need... I need the jail to have a vegan diet. Its more important than this hearing is."LaSota went on to claim that she was being starved and suggested that a jail chaplain had denied her request for a vegan diet as some form of religious persecution. As a result, LaSota contended, she was delirious from malnutrition, which was part of her argument for being granted bail."I think the idea that I [may] be mentally impaired for a month at proceedings because Im in a state of starvation or that somebody with a particular majority religion would be deciding whether my religious beliefs are real... its not right," she said. After LaSota's imploring, the judge told her that her mother had managed to find a way to get her some vegan food while she awaits trial."I hope so," she replied. "I meant what I said about mental impairment. Im in, maybe, a mild state of delirium."LaSota is allegedly quite familiar with inducing delirium. On her blog, per Vox and other outlets, Ziz promoted what's known as "unihemispheric sleep" or UHS, a dangerous practice where one attempts to sleep with only one half of their brain, the other half remaining awake and alert. A lengthy explainer on the Zizians claims, per insider accounts, that the group's alleged leader uses UHS to manipulate people and induce in them a "vulnerable psychological state" a useful tool for any aspiring cult leader.Ultimately, LaSota's bail request was denied because, as Bean put it, the "circumstances are odd at best, concerning" perhaps the biggest understatement of 2025 so far.More on cults of personality: Tesla Owners Receiving Threats That If They Don't Sell Their Cars, They'll Be VandalizedShare This Article

How Do You Pronounce Elon Musk's Son's Name, 'X A-12'?
Elon Musk and singer Grimes have three children together, and all of them have unique names. They have a daughter, Exa Dark Siderl, age 3, and a son, Tau Techno Mechanicus, age 2. But their oldest child, age 4, who showed up in the Oval Office recently, much to mom Grimes' reported dismay, has a rather complicated full name. The boy goes by X, the same letter as the name Musk gave to Twitter and uses in SpaceX. But his full name is more complicated. It's "X A-12" and, when he was born in 2020, Musk appeared on The Joe Rogan Experience podcast and confirmed the name's pronunciation. "How do you say the name?" Rogan asked. "Is it a placeholder?" Apparently not. Musk said at the time that the name is pronounced "X Ash A Twelve." ("" is a character used in some languages, including Danish and Norwegian. It's often pronounced "ash," but some people pronounce each letter, saying "A E.")"First of all, my partner's the one that mostly came up with the name," Musk said of Grimes. "I mean it's just X, the letter X, and the '' is pronounced, 'Ash,' and then, A-12 is my contribution." He went on to say that A-12 stood for "Archangel 12, the precursor to the SR-71, coolest plane ever." The White House appearance involved Musk and X appearing with President Donald Trump in the White House on Tuesday."He should not be in public like this," X's mother, singer Grimes posted, according to The Standard. "I did not see this, thank u for alerting me. But I'm glad he was polite. Sigh." Elon Musk in 2020 with then-newborn X. Elon Musk/TwitterHear Elon Musk pronounce X's full nameIf you want to hear Musk pronounce X's full name, you don't have to fast-forward through much of the video. Rogan asks him to pronounce it just 37 seconds into the 2020 podcast.Grimes tweeted a more detailed explanation of why the various parts of the name were chosen in 2020. She called X "the unknown variable," and said that was "my elven spelling of Ai," which she explained as "love and/or artificial intelligence."As for the A-12, she called the plane "our favorite aircraft," going on to tout its "no weapons, no defenses, just speed. Great in battle, but non-violent." Grimes also noted that the A in A-12 stood for "Archangel," which she said was "my favorite song." She didn't specify which song -- numerous songs are titled Archangel -- but some music sitesguessed she could mean the song by the band Burial. Grimes once cited Burial's Archangel song as a favorite on her Tumblr. She ended her tweet with the words "metal rat" and emoji of crossed swords and a rat. 2020 was the year of the "metal rat" according to the Chinese zodiac, although of course it can also simply mean "fan of heavy metal music."Grimes mistyped SR-17 instead of SR-71, but Musk corrected her in another tweet, writing, "SR-71, but yes."To which she replied, "I am recovering from surgery and barely alive so may my typos b forgiven but, damnit. That was meant to be profound."It's possible the name does not appear on the baby's official California birth certificate -- at least not in the spelling that's been shared by his parents. A California family-law attorney told People magazine that while the name isn't illegal, the state doesn't allow symbols on birth certificates. Apostrophes, such as in a last name like O'Connor, are allowed, and it would seem that the hyphen might also make it through. But symbols like "" might cause the certificate to be rejected, and the parents would have to submit it again. At the time, Musk also noted that he was happy the baby was born on May 4, commonly known as Star Wars Day for the saying "May the fourth (Force) be with you."

Free-to-play Monster Hunter-like Dauntless is shutting down following mass studio layoffs
Free-to-play Monster Hunter-like Dauntless is shutting down following mass studio layoffsPlug being pulled in May. News by Matt Wales News Reporter Published on Feb. 25, 2025 Just weeks after laying off the "majority" of its staff, developer Phoenix Labs has announced it's shutting down its free-to-play Monster Hunter-style action game, Dauntless.Dauntless' fast-paced take on the Monster Hunter formula received a warm reception when it launched into PC early access in May 2018, but it struggled to maintain that early momentum following a wider launch a year on. And its journey is now officially near its end.Announcing Dauntless' closure in a terse message on social media, Phoenix Labs wrote, "Dauntless is shutting down on May 29, 2025. Dauntless will receive no additional content or updates. Dauntless will no longer be available to play on and after May 29th, 2025 at 11.45pm PST. Thanks to all for being a part of the Dauntless journey."Dauntless launched for consoles in 2019.Watch on YouTubeConfirmation of Dauntless' demise follows several rounds of layoffs at Phoenix Labs, which was acquired by crypto company Forte in 2023. Last May, the studio announced it was cancelling all projects other than Dauntless and Fae Farm and laying off staff - a move believed to have impacted 140 employees - in order to "pave a path for a strong future". Then came the news last month that a "majority" of employees would lose their jobs in another round of cuts - which the studio blamed on "unfortunate but necessary changes to our operations".At the time, it said it would discuss the future of Dauntless and Fae Farm "in the coming weeks". And while Dauntless' fate is now sealed, Phoenix Labs hasn't yet shared its plans for Fae Farm.

CHIPS Act dies because employees are fired NIST CHIPS people are probationary
Posted on February 23, 2025February 23, 2025 by Robert MaireCHIPS Act dies because employees are fired NIST CHIPS people are probationary CHIPS Act dies because employees are fired NIST CHIPS people are probationaryby Robert Maire on 02-23-2025 at 6:00 am View ArticlesPrivate Message NIST to lose 100s of mainly CHIPS Act people If no people are left to administer CHIPS Act it dies by default Following USAID play book to kill an unwanted program Using the probationary clause as excuse to fire recent CHIPS hiresTrump will kill CHIPS Act by gutting NIST employeesMuch as was seen in the gutting of the USAID program by essentially firing all of the employees save a few to turn off the lights when exiting, so too will Trumps disliked CHIPS Act program get killed by default by firing all the recently hired CHIPS Act employees using the Probationary excuse to get rid of thousands of other government employees.NIST, which is the government department under which CHIPS lives is expecting 500 or more firings of probationary people. The vast majority of those to be terminated at NIST are associated with the CHIPS Act as they are the most recently hired with most of them being hired in the last year as Biden ramped up the CHIPS Act on his way out the door.If there are no employees left to administer the CHIPS Act program, it is dead by default as there is no one left to certify that companies have met their requirements let alone write the checks.Basically the program will cease to exist.Usurping congress by mass firings. We have confirmed with NIST people we knowNIST people have confirmed that they expect firings soon, likely this week and it sounds like CHIPS Act will be the primary target. Also targeted are a lot of computer security and anti-hacking programs. AI safety programs at NIST appear to be impacted as wellThe NIST news has been confirmed by the mediaMedia outlets have confirmed our view of whats happening at NIST and CHIPS Act impact;Bloomberg article on mass NIST firings in AI and CHIPSThe news was first broken by Axios;Axios article on NIST CHIPS cutsAll National Institute of Standards and Technology probationary employees are bracing to be fired imminently, sources familiar with the matter told Axios. Why it matters: The Trump administrations cuts across the federal government are gutting agencies tasked with testing leading-edge AI technology and boosting domestic semiconductor development and manufacturing. The cuts come at a time when the U.S. is looking to lead in AI development and stave off competition from China.Driving the news: These cuts mean that the U.S. AI Safety Institute, which has been working on ensuring emerging AI models are trustworthy, is gutted, along with most staff working at NISTs Chips for America program.NIST is preparing to cut 497 people, according to sources familiar, which includes:74 postdocs57% of CHIPS staff focused on incentives67% of CHIPS staff focused on R&DContext: NIST is facing an uncertain future. AISI lost its leader earlier this month and its staff were left out of the AI summit in Paris last week.President Trump has also not yet announced a nominee to head up NIST.Tariffs instead of CHIPS ActTrump made it clear over the last few days that he will institute 25% tariffs on imported semiconductor devices, so it obvious that strategy is shifting from incentivizing US chip production to penalizing imports instead. We dont think that the administration has fully thought through all the ramifications as 100% of AI chips are imported from Taiwan and an increasing number of Intel chips are imported along with 100% of AMD and all other TSMC customers and the vast majority of memory chipswell over 80% of chips are foreign made.We think this is more than a negotiating stanceWe dont think these actions are a bluff nor a negotiating tactic, its a complete change of course. Remember Taiwan stole the US chip industry and we wont defend Taiwan because they arent paying us protection moneyWe think that this also reduces the probability of TSMC taking over Intel manufacturing as handing the best US CHIP manufacturing to Taiwan runs counter to the new logicThe stocksAs we stated in our most recent note, the gutting of the CHIPS Act will add to the headwinds that the semiconductor industry is already facing going into 2025.We are starting to think that 2025 could be a down year for WFE rather than a flat to slightly up years as recently expressed by many companies.Obviously chip manufacturing companies will slow spending on programs they previously thought they were getting CHIPS Act funding for if not cancel those projects outright. If I were running a chip company I would not count on CHIPS Act funding even if I had a signed contract as its clearly not worth the paper its written on if NIST is eviscerated.CHIPS Act , I hardly knew ya (Dropkick Murphys)About Semiconductor Advisors LLCSemiconductor Advisors is an RIA (a Registered Investment Advisor), specializing in technology companies with particular emphasis on semiconductor and semiconductor equipment companies.
